How to terminate a lease agreement for a main residence?

Generally speaking, a lease agreement never ends by itself in Belgium. One of the parties must in fact always go through the formality by serving notice of his or her wish to terminate the lease, on pain of serious consequences. This is known as “préavis”! What is it exactly, how and when to give it? The Expat Welcome Desk explains it all to you.

This newsletter mentions only the rules concerning notice applicable to the lease of a main residence in the Brussels-Capital Region.

What is notice?

  • Definition:  Notice is the period of time between the notification of the unilateral termination by one of the parties and the effect end of the agreement. In the case of leases, this is also referred to as surrender or relinquishment (of the lease).
·      Imperative provision:  the notice is an imperative provision in the Code bruxellois du Logement (CBL) [Brussels Housing Code], i.e. one that cannot be derogated from. The parties to the agreement may, however, derogate from it only if the changes are advantageous for the lessee. For examples, the parties may agree that the lessor may not terminate the lease agreement for personal occupation of the premises.

Please note: a notice clause that is more protective of the lessor will be considered as relatively null and void.

How is it calculated?

The legal period of notice is 3 months, but in some cases, it can be 6 months. It always begins on the first day of the month following the month in which the lessor or the lessee received the notice (i.e. a few days after your letter was sent). For example, if your notice was received on 10 March, the notice period starts on 1 April and ends on 30 June (the date on which the lease ends).

There are no exceptional (medical, professional, etc.) reasons for reducing the legal period of notice in Belgium. The parties can always agree in writing on a "termination of the lease by mutual agreement" however, in order to speed up or avoid certain formalities.

When can I terminate the lease agreement?

  • Very short-term lease (less than 6 months) – Article 238 (3), CBL.
  • Short-term lease (from 6 months to 3 years) – Article 238 (4), CBL.
  • Long-term lease (9 years) – Article 237 (2) to (5), CBL.
    • Unregistered lease – Article 227f, CBL.
    • If the leased property is sold – Article 229, CBL
At the end of the lease:

A very short-term lease ends at the expiry of the term agreed therein. This is an exception to the notice rule, because the legislator has agreed that this lease expires at the end of its term without any formality on the part of either party.

Before the end of the lease:

The lease cannot be terminated early.

At the end of the lease:

The lease ends at the expiry of the three-year period, subject to the 3-month notice being given by either party to the lease agreement. In such a case, the notice may be given without citing a reason.

Before the end of the lease:

The parties may also decide to terminate the lease before it expires:

Ø  The lessee may terminate the lease at any time, subject to three months' notice and compensation equivalent to one month's rent.

 

Ø  The lessor may terminate the lease early only after the first year thereof and only in order to occupy the property personally or to have it occupied by a member of his family (or those of his spouse). In such a case, the lessor must give the lessee three months' notice and pay him compensation equivalent to one month's rent.

At the end of the lease:

The lease ends at the expiry of the nine-year period, provided that either party has given at least six months’ prior notice. In such a case, notice may be given without citing a reason.


If neither party terminates the lease at the end of the nine-year period, the lease is extended for a period of three years under the same conditions. Either party may then terminate the extended lease every three years without citing a reason and without having to pay compensation, by giving six months' notice.

Before the end of the lease:

The parties may also decide to terminate the lease before it expires:

Ø  The lessor may take this decision:

- at any time, for personal occupation of the premises (6 months’ notice)

- at the end of the first or second three-year period if the lessor intends to carry out reconstruction, transformation or renovation works on the leased premises (6 months' notice)

- without citing a reason but with compensation, at the end of the first or second three-year period (6 months' notice).

 

In such cases, the lessee may give the lessor a counter-notice of 1 month. This rule does not apply to short-term lease agreements.

 

Ø  The lessee may terminate the lease at any time by giving 3 months' notice. In such a case, the lessee will also pay compensation equivalent to 3, 2 or 1 month’s rent, depending on whether he terminates his occupation during the first, second or third year of the lease.

 

 

If the lease has not been registered, the lessee may terminate it without notice and without paying compensation only if a "formal notice" has been served to the lessor by registered letter with acknowledgement of receipt. This formal notice must call on the lessor to register the lease agreement within one month of the registered letter, otherwise the lessee can break the lease without notice or compensation.

 

If the leased property is sold, several elements must be taken into account in order to determine the period of notice that will be applicable: the term of the lease agreement, registration, period of occupation of the premises by the tenant, etc.

Calculation of the termination fee

If a termination fee is stipulated in the article of the law applicable to the lease agreement, the end date of the period of notice determines the year of the lease in which the agreement ends (and therefore, how much notice is due from the party terminating the lease agreement).

The early termination fee does not necessarily have to be paid at the time the notice is sent but can be paid at the end of the 3 months' notice. This point should be agreed by and between the parties.

 

What information should be included in the notice?

Ø  The identity of both parties to the lease agreement;

Ø  The address of the property being rented;

Ø  The term of the lease;

Ø  The start and end date of the period of notice;

Ø  (If applicable) The reason for breaking the lease agreement;

Ø  (If applicable) The amount of compensation due.

Attention: If you have signed the lease with other people, all of them must sign the notice for it to be valid

If you are married or legally cohabiting, your spouse or legal cohabitant must also sign the notice, even if he or she had not signed the lease.

In what form must the notice be sent?

The Housing Code does not mention a specific form of notice. The way in which the notice is to be served is left to the discretion of the parties, who must specify this in the lease agreement between them.

A simple letter can be chosen for sending the notice. In order to be able to prove the date of notice, however, it is advisable to send the notice by registered letter with acknowledgement of receipt.

It is also possible to send notice by e-mail. Following the reform of the Belgian Civil Code (Article 1.5), e-mail is now recognised as a valid means of notification. Nevertheless, special conditions are required, namely that the recipient must have approved the use of his e-mail address before the notice is sent or if the recipient's approval could be deduced otherwise (e.g. because the two parties have already communicated about the lease agreement by e-mail). Furthermore, the notice must be very explicit, unambiguous and there must be a series of communications between the parties (no "duly noted").

It is not advisable to send the notice by SMS or WhatsApp as it is difficult to prove that the other party has received the notice!

Hoe zeg je een huurovereenkomst voor een hoofdverblijf op?

In België eindigt een huurovereenkomst doorgaans nooit vanzelf. Eén van de partijen dient altijd aan te geven dat hij of zij de huurovereenkomst wil beëindigen, anders kunnen de gevolgen aanzienlijk zijn. Deze formaliteit wordt “de opzegging” genoemd. Maar wat is dat precies. En hoe en wanneer begint u eraan? De Expat Welcome Desk vertelt het u.

Deze nieuwsbrief vermeldt enkel de opzeggingsregels die gelden voor de huur van een hoofdverblijf in het Brussels Hoofdstedelijk Gewest.

De opzeggingstermijn

  • Omschrijving: Dit is de periode die verstrijkt tussen de kennisgeving van de eenzijdige verbreking van de huurovereenkomst door één van de partijen en de effectieve beëindiging van de overeenkomst.
·      Dwingende bepaling: de opzegging is een dwingende bepaling in de Brusselse Huisvestingscode. De partijen kunnen hiervan enkel afwijken voor aanpassingen in het voordeel van de huurder. Zo kunnen zij bijvoorbeeld overeenkomen dat de verhuurder de huurovereenkomst niet kan beëindigen om zelf de woning te betrekken.

N.B.: een opzeggingsclausule die grotere bescherming biedt aan de verhuurder is nietig.

Hoe wordt de opzeggingstermijn berekend?

De wettelijke termijn om een huurovereenkomst op te zeggen, bedraagt 3 maanden en in een aantal gevallen 6 maanden. De termijn begint altijd op de eerste dag van de maand die volgt op de maand waarin de verhuurder of de huurder de opzegging heeft ontvangen (enkele dagen na de verzending van uw brief dus). Is uw opzegging bijvoorbeeld aangekomen op 10 maart, dan loopt de opzeggingstermijn van 1 april tot 30 juni (de einddatum van de huurovereenkomst).

Er bestaan in België geen uitzonderlijke redenen (van medische of professionele aard bijvoorbeeld) om de wettelijke opzeggingstermijn in te korten. Wel kunnen de partijen steeds schriftelijk een "verbreking van de huurovereenkomst met wederzijdse instemming" overeenkomen om bepaalde formaliteiten te versnellen of uit de weg te gaan.

Wanneer kan ik de huurovereenkomst beëindigen?

  • Huurovereenkomst van zeer korte duur (van minder dan 6 maanden)- artikel 238, derde lid van de Huisvestingscode
  • Huurovereenkomst van korte duur (van 6 maanden tot 3 jaar) - artikel 238, vierde lid van de Huisvestingscode
  • Huurovereenkomst van lange duur (9 jaar) – artikel 237, lid 2 tot 5 van de Huisvestingscode
    • Niet-geregistreerde huurovereenkomst - artikel 227f van de Huisvestingscode
    • Bij verkoop van het verhuurde goed – artikel 229 van de Huisvestingscode
Bij het verstrijken van de huurovereenkomst:

De huurovereenkomst van zeer korte duur eindigt bij het verstrijken van de termijn die in de huurovereenkomst is overeengekomen. Dit geldt als uitzondering op de opzeggingsregel omdat de wetgever voor deze huurovereenkomst bepaalt dat de huurovereenkomst op het einde van de looptijd afloopt zonder dat één van beide partijen enige formaliteit hoeft te vervullen.

Vóór het verstrijken van de huurovereenkomst:

Deze huurovereenkomst kan niet voortijdig worden beëindigd.

Bij het verstrijken van de huurovereenkomst:

De huurovereenkomst eindigt bij het verstrijken van de driejarige periode mits één van beide partijen van de huurovereenkomst de andere een opzeggingstermijn van drie maanden aanzegt. Daarbij hoeft geen reden te worden opgegeven voor de opzegging.

Vóór het verstrijken van de huurovereenkomst:

De partijen kunnen ook beslissen de huurovereenkomst vóór de einddatum te beëindigen:

Ø  De huurder kan de overeenkomst op ieder moment opzeggen, mits deze een opzeggingstermijn van drie maanden in acht neemt en een vergoeding van één maand huurgeld betaalt.

Ø  De verhuurder mag de huurovereenkomst enkel voortijdig beëindigen na het eerste huurjaar en enkel om de woning zelf te betrekken of te laten betrekken door een lid van zijn of haar familie (of van de levenspartner).  In dat geval dient de verhuurder een opzegging van drie maanden toe te staan aan de huurder en deze een vergoeding te storten ten belope van één maand huurgeld.

Bij het verstrijken van de huurovereenkomst:

De huurovereenkomst eindigt bij het verstrijken van de negenjarige periode op voorwaarde dat één van beide partijen van de huurovereenkomst de andere een opzeggingstermijn van zes maanden aanzegt. In dat geval hoeft geen reden te worden opgegeven voor de opzegging.

Indien geen van de partijen de overeenkomst op het einde van de negenjarige periode opzegt, loopt de overeenkomst onder dezelfde voorwaarden voor drie jaar verder. Elke partij kan vervolgens de verlengde huurovereenkomst om de drie jaar zonder motivering en zonder schadevergoeding beëindigen met inachtneming van een opzeggingstermijn van zes maanden.

Vóór het verstrijken van de huurovereenkomst:

De partijen kunnen ook beslissen om de huurovereenkomst vóór de einddatum te beëindigen:

Ø  De verhuurder mag dit beslissen:

- op ieder moment als het is om de woning zelf te betrekken (opzeggingsduur van zes maanden)

- bij het verstrijken van de eerste of de tweede driejarige periode als de eigenaar overweegt om heropbouw-, verbouwings- of renovatiewerken uit te voeren in het verhuurde goed (opzeggingsduur van zes maanden)

- zonder een reden te vermelden maar wel mits de betaling van een vergoeding bij het verstrijken van de eerste of de tweede driejarige periode (opzeggingsduur van zes maanden).

 

In deze gevallen kan de huurder de verhuurder een tegentermijn van één maand aanzeggen. Deze regel geldt niet voor overeenkomsten van korte duur.

 

Ø  De huurder kan de huurovereenkomst steeds beëindigen als hij of zij een opzeggingstermijn van drie maanden in acht neemt. In dat geval is tevens een vergoeding van 3, 2 of 1 maand huur verschuldigd naargelang deze de huurperiode beëindigt tijdens het eerste, tweede of derde jaar van de huurovereenkomst.

 

Wanneer de huurovereenkomst niet is geregistreerd, kan de huurder deze zonder opzegging en zonder betaling van de boete enkel beëindigen als aan de verhuurder een "ingebrekestelling" is toegestuurd bij aangetekend schrijven met ontvangstbewijs. Deze ingebrekestelling moet de verhuurder ertoe aanzetten de huurovereenkomst binnen een maand na de aangetekende brief te registreren. Gebeurt dit niet, dan kan de huurder de huurovereenkomst zonder opzegging of schadevergoeding verbreken.

 

Indien het gehuurde goed verkocht gaat worden, moet bij de vaststelling van de opzeggingstermijn met verschillende elementen rekening worden gehouden, zoals de duur van de huurovereenkomst, de registratie, de duur van de bewoning door de huurder...

Berekening van de verbrekingsvergoeding

Als een verbrekingsvergoeding bepaald wordt in het wetsartikel dat voor de huurovereenkomst geldt, is het de einddatum van de opzeggingstermijn die bepaalt in welk jaar van de huurovereenkomst deze eindigt (en dus hoeveel de partij die de huurovereenkomst beëindigt, verschuldigd is).

De vergoeding voor de vroegtijdige verbreking hoeft niet noodzakelijk betaald te worden bij het versturen van de opzegging. Dit kan ook bij het verstrijken van de drie maanden vooropzeg, maar dit moet tussen de partijen worden overeengekomen.

 

Welke informatie dient de opzegging te vermelden?

Ø  De identiteit van de beide partijen van de huurovereenkomst;

Ø  Het adres van het verhuurde goed;

Ø  De duur van de overeenkomst;

Ø  De aanvangs- en einddatum van de opzeggingsperiode;

Ø  (Indien van toepassing) De reden voor de verbreking van de huurovereenkomst;

Ø  (Indien van toepassing) Het bedrag van de verschuldigde vergoeding.

Opgelet. Hebt u de huurovereenkomst samen met andere personen ondertekend, dan moeten deze ook allemaal de opzegging ondertekend hebben om geldig te zijn.

Bent u gehuwd of woont u wettelijk samen, dan dient uw echtgenoot of wettelijk samenwonende partner eveneens de opzegging te ondertekenen, ook al hebben deze de huurovereenkomst niet onderschreven.

Onder welke vorm moet de opzegging verstuurd worden?

De Brusselse Huisvestingscode maakt geen specifieke melding van de vorm van de opzegging. De wijze waarop deze wordt overgemaakt, wordt overgelaten aan het oordeel van de partijen, die dit in de huurovereenkomst moeten vastleggen.

Bij de verzending van de kennisgeving kan alvast worden gekozen voor een eenvoudige brief. Om de datum van de opzegging te kunnen aantonen, is het echter raadzaam de opzegging te versturen per aangetekend schrijven met ontvangstbewijs.

De opzegging kan ook per e-mail gebeuren. Sinds de hervorming van het Burgerlijk Wetboek (artikel 1.5 Cc) wordt e-mail voortaan erkend als geldig middel voor kennisgeving. Hieraan zijn wel bijzondere voorwaarden verbonden, namelijk dat de ontvanger het gebruik van zijn e-mailadres moet hebben goedgekeurd vóór de verzending van de kennisgeving of als de goedkeuring van de ontvanger op een andere wijze kan worden afgeleid (bijvoorbeeld omdat de twee partijen al meermaals per e-mail contact hebben gehad over de huurovereenkomst). Bovendien moet de opzegging zeer uitdrukkelijk en ondubbelzinnig zijn en moet er sprake zijn van een opeenvolging van berichten tussen partijen ("OK" is niet voldoende).

Het is niet raadzaam om de opzegging per sms of whatsapp-bericht te versturen omdat moeilijk kan worden aangetoond dat de andere partij deze wel degelijk heeft ontvangen!

Comment mettre fin à un contrat de location de résidence principale?


En Belgique, en général, un contrat de location ne prend jamais fin de lui-même. Une des parties doit en effet toujours accomplir une formalité en notifiant son souhait de mettre fin au bail sans quoi des conséquences importantes s’en suivent. C’est ce qu’on appelle le préavis ! Cette newsletter ne mentionne que les règles de préavis applicables au contrat de bail de résidence principale en Région de Bruxelles-Capitale.

Qu’est-ce que le préavis ?

  • Définition :  C'est le laps de temps qui s’écoule entre la notification de la rupture unilatérale du contrat de bail par l’une des parties et le terme effectif du contrat. En matière de bail, on parle de congé ou renon.
·      Disposition impérative : le préavis est une disposition impérative dans le Code bruxellois du Logement (C.B.L.) à savoir à laquelle on ne peut pas déroger. Cependant, les parties au contrat peuvent y déroger uniquement si les modifications sont avantageuses pour le preneur. Par exemple, les parties peuvent convenir que le bailleur ne pourra pas mettre fin au contrat de bail pour occupation personnelle.

N.B. : une clause de préavis plus protectrice envers le bailleur sera frappée de nullité relative.

Comment le calculer ?

Le préavis légal est de 3 mois mais il peut parfois être de 6 mois dans certains cas. Il commence toujours le premier du jour du mois qui suit le mois durant lequel le propriétaire ou le locataire a reçu le préavis (soit quelques jours après l’envoi de votre courrier). Par exemple, si votre préavis a été reçu le 10 mars, le préavis commence le 1er avril et se finit le 30 juin (date à laquelle le contrat de bail prend fin).

Il n’existe pas de motif exceptionnel (médical, professionnel, etc.) permettant de bénéficier d’une réduction du délai légal de préavis en Belgique. Mais il est toujours possible entre parties de se mettre d’accord par écrit sur une « rupture du bail de commun accord » pour accélérer ou éviter certaines formalités.

A quel moment puis-je mettre fin au contrat de bail ?

  • Bail à très court terme (de moins de 6 mois)- article 238, al. 3 C.B.L.
  • Bail à court terme (de 6 mois à 3 ans)- article 238, al. 4 C.B.L.
  • Bail à long terme (9 ans) - article 237, al. 2 à 5 C.B.L.
    • Bail non enregistré - article 227f C.B.L.
    • En cas de vente du bien loué – article 229 C.B.L.
A l’expiration du bail :

Le bail à très court terme prend fin à l’expiration de la durée convenue dans le bail. Il s’agit là d’une exception à la règle du préavis car pour ce bail, le législateur a convenu que le bail prenait fin à son terme sans qu’une des parties ne doive accomplir de formalité.

Avant l’expiration du bail :

Il n’est pas possible d’y mettre fin anticipativement.

A l’expiration du bail :

Le bail prend fin à l’issue de la période de trois ans, sous réserve de l’envoi du préavis de 3 mois par l’une ou l’autre des parties au contrat de bail. Dans ce cas, le préavis peut être donné sans motif.

Avant l’expiration du bail :

Les parties peuvent également décider de mettre un terme au bail avant son échéance :

Ø  Le preneur peut résilier le bail à tout moment, moyennant un préavis de trois mois et une indemnité équivalente à un mois de loyer.

 

Ø  Le bailleur peut mettre fin au bail anticipativement, uniquement après la première année de location et seulement pour occuper le bien personnellement ou le faire occuper par un membre de sa famille (ou ceux de son conjoint). Dans cette hypothèse, le bailleur devra notifier au preneur un préavis de trois mois et lui verser une indemnité équivalente à un mois de loyer.

A l’expiration du bail :

Le bail prend fin à l’issue de la période de neuf ans, à condition que l’une ou l’autre des parties ait donné congé au moins six mois avant son échéance. Dans ce cas, le préavis peut être donné sans motif.


Si aucune des deux parties ne met fin au bail à l’expiration de cette période de neuf ans, le bail est prolongé pour une durée de trois ans aux mêmes conditions. Chacune des parties a alors la faculté de mettre fin au bail prorogé, tous les trois ans, sans motif et sans devoir payer d’indemnité, moyennant un congé de six mois.

Avant l’expiration du bail :

Les parties peuvent également décider de mettre un terme au bail avant son échéance :

Ø  Le bailleur peut prendre cette décision :

- à tout moment, pour occupation personnelle (préavis de 6 mois)

-à l’échéance du premier ou deuxième triennat s’il envisage de procéder à des travaux de reconstruction, transformation ou rénovation du bien loué (préavis de 6 mois)

- sans motif mais moyennant indemnité, à l’échéance du premier ou du deuxième triennat. (préavis de 6 mois).

 

Dans ces cas, le preneur peut alors donner un contre-péavis d’un mois au bailleur. Cette règle ne vaut pas pour les contrats de courte durée.

 

Ø  Le preneur est autorisé à mettre fin au bail, à tout moment, moyennant un congé de 3 mois. Dans ce cas, il payera en outre une indemnité de 3, 2 ou 1 mois de loyer selon qu’il mettra fin à son occupation durant la première, seconde ou troisième année du bail.

 

 

Si le contrat de bail n’a pas été enregistré, le preneur peut mettre fin au contrat de bail sans préavis et sans payer la pénalité seulement si une « mise en demeure », par lettre recommandée avec accusé de réception, a été envoyée au bailleur. Cette mise en demeure doit l’inviter à enregistrer le contrat de bail dans le mois suivant ce courrier recommandé. Si cela n’est pas fait, le preneur peut rompre le bail sans préavis, ni indemnités.

 

Si le bien loué est vendu, plusieurs éléments doivent être pris en compte afin de déterminer le préavis qui sera applicable: durée du contrat de bail, enregistrement, durée d’occupation des lieux par le locataire…

Calcul de l’indemnité de rupture

Si une indemnité de rupture est prévue par l’article de loi applicable au contrat de bail, c’est la date de fin du préavis qui détermine dans quelle année du bail le contrat prend fin (et donc, quelle est la somme du préavis qui est dû par la partie qui met un terme au contrat de bail).

L’indemnité de rupture anticipée ne doit pas être nécessairement payée au moment où le préavis est envoyé mais peut être payée à la fin des 3 mois de préavis. Ce point doit faire l’objet d’un arrangement entre les parties.

 

Quelles informations doit mentionner le préavis?

Ø  L’identité des deux parties du contrat de bail ;

Ø  L’adresse du bien qui fait l’objet de la location ;

Ø  La durée du bail ;

Ø  La date de début et de fin du préavis ;

Ø  (Si cela est d’application ) Le motif de rupture du contrat de bail ;

Ø  (Si cela est d’application) Le montant de l’indemnité due.

Attention, si vous avez signé le bail avec d'autres personnes, toutes ces personnes doivent signer le préavis pour qu'il soit valable

Si vous êtes mariés ou cohabitants légaux, votre époux ou cohabitant légal doit aussi signer le préavis, même s'il n'avait pas signé le bail.

Sous quelle forme le préavis doit-il être envoyé ?

Le C.B.L. ne mentionne pas une forme de préavis déterminée. La façon de communiquer le préavis est laissée à l’appréciation des parties qui doivent préciser cela dans le contrat de bail qui les lient.

Un simple courrier peut être choisi pour l’envoi du préavis. Cependant, afin de pouvoir prouver la date certaine du préavis, il est conseillé d’envoyer son préavis par lettre recommandé avec accusé de réception.

Il est également possible d’envoyer son préavis par e-mail. Suite à la réforme du Code civil belge (article 1.5 Cc), l’e-mail est désormais reconnu comme un moyen valable de notification. Néanmoins, des conditions particulières sont exigées, à savoir que le destinataire doit avoir approuvé l’utilisation de son adresse e-mail avant l’envoi de la notification ou si l’approbation du destinataire a pu être déduite autrement (notamment car les deux parties ont déjà échangés plusieurs fois par rapport au contrat de bail par e-mail). En outre, le préavis doit être très explicite, sans ambiguïté et il faut une série de communication entre les parties (pas de "bien noté").
