Inheritance and Matrimonial Property Rules in the EU
Many European Union citizens live outside their home country, and more and more mixed couples of different European origins are being formed. These couples often have assets or bank accounts in several countries, and are consequently faced with legal uncertainty and substantial costs when they have to divide their assets in the event of divorce, separation or death.
It is difficult for them to know at present which courts are competent and which laws apply to their situation and assets in each EU country. The rules vary from one country to another and can sometimes be contradictory.
To resolve this issue, the Notaries of Europe have created specific websites, presented by the Expat Welcome Desk.
Available in 21 languages, the "coupleseurope.eu" website provides an overview of marital property regimes and partnerships in force in the twenty-seven EU Member States. It answers practical legal questions such as: What are the consequences of divorce or separation for matrimonial property? Which law applies to a couple's assets? What are the consequences of death with regard to the matrimonial property regime?
The content of the website is moreover updated regularly to stay abreast of developments in European and national legislation.
The rules governing inheritance are highly complex and vary from one Member State to another. This can lead to a great deal of legal uncertainty, which is often not appreciated by heirs who face legal and administrative complications when they inherit property located in another Member State, but also by those who want to organise their succession during their lifetime.
The "succession-europe.eu" website contains a database on inheritance law in 22 Member States. It is an ideal tool to consult before seeing your notary. The content is also updated regularly.
Where can I find a notary who speaks my language?
Do not hesitate to consult a notary for your questions about inheritance procedures, drawing up a will or a matrimonial property regime, buying a property, etc.
You can find the contact details of a notary throughout the European Union who speaks your language in the European Directory of Notaries, e.g. a notary in Prague who speaks French and can help you with local procedures (buying a property, settling an inheritance, etc.).
Erfopvolging en huwelijksstelsels in de Europese Unie
Veel burgers van de Europese Unie wonen buiten hun land van herkomst en het aantal gemengde koppels van verschillende Europese achtergronden neemt toe. De website Koppels in Europa/Couples in Europe is beschikbaar in 21 talen en verschaft een overzicht van de huwelijksvermogensstelsels en het partnerrecht die gelden in de zevenentwintig lidstaten van de Europese Unie. De website geeft antwoord op concrete juridische vragen zoals bijvoorbeeld: Wat zijn de gevolgen van een echtscheiding of scheiding van tafel en bed voor het huwelijksvermogensstelsel? Welke wetgeving is van toepassing op de goederen van een echtpaar? Welke gevolgen heeft een overlijden voor het huwelijksvermogensstelsel?
De inhoud van de website wordt geregeld bijgewerkt om gelijke tred te houden met wijzigingen in de Europese en nationale wetgeving.
De regels die gelden voor nalatenschappen zijn zeer complex en verschillen van lidstaat tot lidstaat. Dit kan leiden tot een grote rechtsonzekerheid die vaak niet erg op prijs wordt gesteld door erfgenamen, die in een juridisch en administratief kluwen terechtkomen wanneer zij een eigendom erven in een andere lidstaat, maar evenmin door diegenen die hun erfopvolging bij leven al willen regelen.
De website "Successions in Europe" biedt toegang tot een gegevensbank met informatie over het erfrecht in 22 lidstaten. Het is een ideaal hulpmiddel om te raadplegen voordat u langsgaat bij uw notaris. Ook hier wordt de inhoud regelmatig geüpdatet.

Dankzij de Europese Gids van Notarissen vindt u overal in de Europese Unie de contactgegevens van een notaris die u in uw eigen of een vertrouwde taal te woord kan staan. Zo vindt u via de gids in Praag bijvoorbeeld een notaris die Frans spreekt en u kan helpen met de plaatselijke procedures (een onroerend goed kopen, een erfenis regelen enz.).

Il répond à des questions juridiques concrètes. Ex : Quelles sont les conséquences d’un divorce ou d’une séparation au regard du régime matrimonial ?
