New rules about the indexation of rents

Aimed at reducing the effects of the energy crisis on tenants, the governments of Belgium’s three regions have adopted new provisional decrees/orders that make the possibility of indexing rents conditional on the result of the building’s EPB (Energy Performance of Buildings) certificate. In addition, new obligations have now been imposed on owners prior to any indexation being applied. How is the indexed amount calculated? Are there any conditions attached? From when does the new method of calculating indexation come into effect? The Expat Welcome Desk tells you all about it.
 

What is indexation?


Indexation is where rents are adjusted in line with the cost of living. This adjustment is due once a year on the anniversary date of the lease coming into effect, under conditions set out in article 1728a of the Civil Code.

The clause that relates to the indexation of your rent must be stated expressly in your written lease contract.

When can the owner demand indexation?


In view of the fact that the indexation of your rent is not automatic, the owner is required, in principle, to notify the tenant of its demand, in writing, on the anniversary date of the lease coming into effect (i.e. on the date the tenant took effective possession of the property).

However, the demand can be made later in the year if the owner forgets to make it on the anniversary date of the lease. If this is the case, the owner can only claim index arrears for the 3 months prior to making the request for indexation.

How is the amount of the indexation calculated?


The indexation of your rent can only be calculated using a formula that is set by law.

  • Base rent (excluding expenses and/or charges owed by the tenant): the rent stated in the lease contract
  • Starting index: the health index for the month preceding the signing of the lease
  • New index: the health index for the month preceding the anniversary of the start of the lease (the date on which you took possession of the property).

What is the aim of this new method of calculation, based on the EPB?


The aim is to reduce the effects of inflation for tenants facing the energy crisis and to encourage landlords to upgrade their properties.

This means that, on a temporary basis, indexation of the rent will be calculated based on the EPB certificate for the rented property. As a reminder, the EPB certificate shows the energy performance of the property on a scale ranging from A (very economical) to G (high energy consumption). This energy performance is established based on the energy characteristics of the property, including the floor area, the level of insulation in the heat loss walls, the type of heating and energy used, the presence of solar panels, etc.

NB: the application of this method of calculation is currently provisional in the 3 Regions.

In the Brussels Capital Region – Order of 13.10.2022, MB (Official journal), 14.10.2022


First and foremost, two conditions must be met to enable the owner to demand indexation of the rent:
  • The owner must have registered the lease (art. 227 of the Brussels Housing Code);
  • The owner must send the EPB certificate for the property being rented to the tenant.

If these two cumulative conditions are met, the owner may make a provisional calculation of the indexation of the rent, based on the EPB for the property:
  • The rents for dwellings with an A, B, C or D category EPB may be indexed 100%;
  • Indexation may only be applied 50% for dwellings with an E category EPB;
  • The rents for dwellings with a category F or G category EPB cannot be indexed.

This standard applies from 14th October 2022 until 13th October 2023.

In the Walloon Region – Decree of 19.10.2022, MD, 03.11.2022


Since 1st September 2018, owners have been required to register the lease contract so that they can demand indexation of the rent.

This is how indexation based on the EPB is calculated in Wallonia:
  • 100% indexation is only possible if the owner is able to present an energy class A, B or C category EPB certificate;
  • Energy class D category EPB: the owner may index the rent 75%;
  • Energy class E category EPB: 50% indexation of the rent may be requested;
  • Energy class F or G category EPB (or no EPB certificate): the owner cannot index the rent.

This standard came into effect on 1st November 2022 and will apply until 31st October 2023.

In the Flemish Region - Decree of 03.10.2022, MB, 04.10.2022


As with the other two regions, the lease must be registered to enable the owner to demand indexation of the rent. In addition, the obligation to provide an EPB certificate to the tenant has applied since 1st January 2019 at the time a dwelling is rented out.

This is how indexation based on the EPB is calculated on a provisional basis in Flanders:
  • Labels A+, A, B or C: there are no indexation restrictions. The calculation of the rent can therefore be established according to the legal formula;
  • Label D: only half of the indexation may be applied;
  • Labels E or F or if no EPB certificate is available: the rent cannot be indexed. Indexation from 1st October cannot be applied.
This standard came into effect on 1st October 2022 and will apply until 30th September 2023.

A few important details

  • The landlord must mandatorily register the current lease to be able to demand indexation of the rent. This is the case even if registering the lease was not obligatory at the time the lease contract was signed;
  • The measure is not retroactive and hence the landlord cannot apply this method of calculation for a date prior to this standard coming into effect.

Om de gevolgen van de energiecrisis voor de huurders te beperken, hebben de drie gewestregeringen nieuwe decreten/ordonnanties uitgevaardigd die het resultaat van het EPB-certificaat tijdelijk als voorwaarde verbinden aan een indexering van de huurprijs. Ook zijn er nieuwe plichten voor verhuurders in de aanloop naar een eventuele indexering. Hoe wordt de indexering berekend? Is een indexering verbonden aan voorwaarden? Wat is een indexering?

Indexering is een aanpassing van de huurprijs aan de levenskost en is één keer per jaar toegestaan op de verjaardag van de huurovereenkomst tegen de voorwaarden die vermeld staan in artikel 1728bis van het Burgerlijk Wetboek.

De bepaling met betrekking tot de indexering dient uitdrukkelijk vermeld te staan in uw schriftelijke huurovereenkomst.


Wanneer mag de eigenaar een indexering vragen?

Aangezien de huurindexering niet automatisch gebeurt, moet de verhuurder het verzoek normaal gesproken schriftelijk aan de huurder overmaken op de dag waarop het ingaan van de huurovereenkomst verjaart (d.w.z. de datum waarop de huurder de woning destijds betrokken heeft).

De vraag kan echter ook later dat jaar worden geformuleerd als de verhuurder dit vergeet op de verjaardatum van de huurovereenkomst. In dat geval kan de verhuurder enkel aanspraak maken op achterstallige betalingen voor de 3 maanden voorafgaand aan de maand waarin hij om indexering verzoekt.

Hoe bereken je de indexering?

Voor de indexering van uw huur komt slechts één berekeningswijze in aanmerking en die is vastgesteld bij wet.

  • Basishuurprijs (zonder de kosten en/of lasten die de huurder verschuldigd is): de huurprijs vermeld in de huurovereenkomst
  • Startindex: de gezondheidsindex van de maand die aan de ondertekening van de huurovereenkomst voorafgaat
  • Nieuwe index: de gezondheidsindex van de maand die voorafgaat aan de verjaardag van de startdatum van de huurovereenkomst (datum waarop de woning betrokken werd).

Wat is het doel van de nieuwe berekeningsmethode die berust op het EPB?

De bedoeling van de nieuwe methode is de weerslag van de inflatie te verminderen voor huurders die getroffen worden door de energiecrisis en verhuurders aan te sporen hun panden te moderniseren.

Tijdelijk wordt de indexering van de huurprijs dus berekend op basis van het EPB-attest van de huurwoning. Ter herinnering: het EPB-attest toont de energieprestaties van de woning op een schaal van A (zeer energie-efficiënt) tot G (zeer energie-intensief). Deze energieprestaties worden vastgesteld op basis van de energiekenmerken van de woning, zoals onder meer de oppervlakte, de isolatiegraad van de muren met warmteverlies, het soort verwarming en de gebruikte energie, de aanwezigheid van zonnepanelen e.d.

N.B.: deze berekeningsmethode wordt momenteel op voorlopige basis toegepast in de drie Gewesten.

Voorwaarden voor indexering in de drie Gewesten:

In het Brussels Hoofdstedelijk Gewest – Ordonnantie van 13.10.2022, BS 14.10.2022

In de eerste plaats moet aan twee voorwaarden voldaan zijn voordat de eigenaar mag vragen om de huurprijs te indexeren:
  • De eigenaar moet de huurovereenkomst geregistreerd hebben (art. 227 van de Brusselse Huisvestingscode);
  • De eigenaar dient het EPB-attest van de huurwoning aan de huurder over te maken.

Als aan deze twee cumulatieve voorwaarden voldaan is, mag de eigenaar tijdelijk de huurindexering berekenen in functie van het EPB van de woning:

  • De huur van woningen waarvoor een EPB-attest A, B, C of D kan worden voorgelegd, mag geïndexeerd worden tegen 100%;
  • De indexering mag slechts voor 50% worden toegepast voor woningen met een EPB-attest E;
  • De huurprijs van woningen met een attest van categorie F of G mag niet geïndexeerd worden.

Deze norm geldt sinds 14 oktober 2022 en tot 13 oktober 2023.

In het Waals Gewest – decreet van 19.10.2022, BS 03.11.2022


Sinds 1 september 2018 is de eigenaar verplicht de huurovereenkomst te registreren als deze om een huurindexering wenst te vragen.

De indexering op basis van het EPB gebeurt in Wallonië daarmee tijdelijk als volgt:
  • Een indexering tegen 100 % is enkel mogelijk als de eigenaar een EPB-attest van energieklasse A, B of C kan voorleggen.
  • EPB van energieklasse D: de eigenaar mag de huur indexeren tegen 75%;
  • EPB van energieklasse E: er mag een indexering worden gevraagd voor 50% van de huur;
  • EPB van energieklasse F of G (of geen EPB-attest): de eigenaar mag de huurprijs niet indexeren.
Deze norm trad in werking op 1 november 2022 en geldt tot 31 oktober 2023.

In het Vlaams Gewest - Decreet van 03.10.2022, BS 04.10.2022

Net zoals in de twee andere Gewesten moet de huurovereenkomst geregistreerd zijn vóór de eigenaar mag vragen om indexering van de huur. Daar bovenop geldt sinds 1 januari 2019 de verplichting om een EPB-attest voor te leggen als een woning verhuurd wordt.

De indexering op basis van het EPB-attest gebeurt in Vlaanderen nu tijdelijk als volgt:
  • Een label A+, A, B of C: er geldt geen beperking voor de indexering. De huurprijs kan dus worden berekend volgens de wettelijke formule;
  • Een D label: slechts de helft van de indexering mag worden toegepast;
  • Een E of F label of wanneer er geen EPB-attest beschikbaar is: de huurprijs mag niet geïndexeerd worden. De indexering vanaf 1 oktober mag niet worden toegepast.
Deze norm geldt van 1 oktober 2022 tot 30 september 2023.

Enkele bemerkingen

  • De verhuurder is verplicht de lopende huurovereenkomst te laten registreren om een indexering van de huurprijs te kunnen vragen, ook al is de registratie van de overeenkomst niet verplicht bij de ondertekening hiervan;
  • De maatregel is niet retroactief, dus de verhuurder mag deze berekeningsmethode niet toepassen op een periode vóór de inwerkingtreding van deze norm.

Afin de réduire les effets de la crise énergétique pour les locataires, les gouvernements des trois régions ont adopté de nouveaux décret/ordonnance qui conditionnent la possibilité d'indexer le loyer au résultat du certificat PEB, et ce de manière temporaire. Qu’est-ce que l’indexation ?

L’indexation est l'adaptation du loyer au coût de la vie, et est due une fois par année à la date d'anniversaire de l'entrée en vigueur du bail, dans les conditions prévues à l'article 1728bis du Code civil.

La clause relative à l’indexation doit être expressément mentionnée dans votre contrat de bail écrit.


Quand est-ce que le propriétaire peut faire la demande ?

Étant donné que l’indexation du loyer n’est pas automatique, le propriétaire doit en principe notifier la demande par écrit à son locataire à la date anniversaire de l’entrée en vigueur du bail (c’est-à-dire la date à laquelle il a effectivement pris possession des lieux).

Toutefois, la demande peut être faite plus tard dans l’année si le propriétaire oublie de le faire à date anniversaire du bail. Si c’est le cas, le propriétaire peut réclamer des arriérés uniquement pour les 3 mois précédant le mois de sa demande d'indexation.

Comment calculer l’indexation ?

L’indexation de votre loyer se calcule uniquement selon une formule fixée par la loi.

  • Loyer de base (hors frais et/ou charges dûs par le locataire) : loyer indiqué dans le contrat
  • Indice de départ : indice santé du mois qui précède la signature du bail
  • Nouvel indice : indice santé du mois qui précède l'anniversaire du début du bail (date de l'entrée dans le logement).

Quel est le but de la nouvelle méthode de calcul basée sur le PEB?

L’objectif est de réduire les effets de l’inflation pour les locataires confrontés à la crise énergétique et d’encourager les propriétaires à moderniser leurs biens.

Temporairement l’indexation du loyer sera donc calculée sur base de certificat PEB du bien mis en location. Pour rappel, le certificat PEB affiche la performance énergétique du bien sur une échelle allant de A (très économe) à G (très énergivore). Cette performance énergétique est établie sur base des caractéristiques énergétiques du bien dont les superficies, le degré d'isolation des parois de déperdition, le type de chauffage et d'énergie utilisée, l’existence de panneaux solaires…

N.B. : l’application de cette méthode de calcul est actuellement provisoire dans les 3 régions.

Rappel des conditions d’indexation dans les  trois Régions :

En région de Bruxelles-Capitale - Ordonnance du 13.10.2022, MB, 14.10.2022


Avant tout, deux conditions doivent être remplies pour que le propriétaire puisse demander l’indexation du loyer :

  • Le propriétaire doit avoir enregistré son bail (art. 227 du Code bruxellois du Logement) ;
  • Le propriétaire doit transmettre le certificat PEB du bien mis en location au locataire.

Si ces deux conditions cumulatives sont respectées, le propriétaire peut calculer temporairement l’indexation du loyer en fonction du PEB du bien :

  • Les loyers des logements disposant d'un PEB A, B, C ou D peuvent être indexés 100% ;
  • L’indexation ne pourra être appliquée qu’à 50% pour les logements disposant d’un certificat PEB E ;
  • Les loyers des logements ayant un PEB de catégorie F ou G ne peuvent pas être indexés.
Cette norme est d’application depuis le 14 octobre 2022 jusqu’au 13 octobre 2023 et s’applique aux baux dont la date anniversaire tombe à compter du jour de l’entrée en vigueur de l’ordonnance, soit à compter du 14 octobre 2022.

En région wallonne - décret du 19.10.2022, MB, 03.11.2022

Depuis le 1er septembre 2018, le propriétaire doit obligatoirement enregistrer le contrat de bail pour que le propriétaire puisse demander une indexation du loyer.

Voici comment l’indexation basée sur le PEB se calcule temporairement en Wallonie :

  • Une indexation de 100 % n’est possible que si le propriétaire peut présenter un certificat PEB de classe énergétique A, B ou C.
  • PEB de classe énergétique D : le propriétaire peut indexer le loyer de 75% ;
  • PEB de classe énergétique E : une indexation de 50% du loyer peut être demandée ;
  • PEB de classe énergétique F ou G (ou pas de certificat PEB) : le propriétaire ne peut pas indexer le loyer.

Cette norme est entrée en vigueur le 1er novembre 2022 et sera applicable jusqu’au 31 octobre 2023.

En région flamande - Décret du 03.10.2022, MB, 04.10.2022

À l’instar des deux autres régions, le bail doit être enregistré pour que le propriétaire puisse demander une indexation du loyer. En outre, l’obligation de fournir un certificat PEB au locataire est d’application depuis le 1er janvier 2019 lorsqu’un logement est mis en location.

Voici comment l’indexation basée sur le PEB se calcule temporairement en Flandres :
  • Label A+, A, B ou C : il n’y pas de limitation de l’indexation. Le calcul du loyer peut donc être établi selon la formule légale ;
  • Label D : seule la moitié de l’indexation peut être appliquée ;
  • Label E ou F ou si aucun certificat PEB n’est disponible : le loyer ne peut pas être indexé. L’indexation à partir du 1er octobre ne peut être appliquée.
Cette norme est d’application du 1er octobre 2022 et sera applicable jusqu’au 30 septembre 2023.

Quelques précisions 

  • Le bailleur doit obligatoirement faire enregistrer le bail en cours pour demander l’indexation du loyer et ce, même si l’enregistrement n’était pas obligatoire au moment de la signature du contrat de bail ;
  • La mesure n’est pas rétroactive donc le bailleur ne peut pas appliquer cette méthode de calcul pour une date antérieure à la date d’entrée en vigueur de cette norme.
