Inflation: how to cope with rising costs?

The day-to-day cost of living is increasing due to inflation, with prices soaring across the board. Whether it's gas & electricity bills, rent & rental charges, fuel prices…, the Expat Welcome Desk has got some tips to help you manage these expenses!

Significant rent increases

This year, rents that are index-linked to inflation have been rising particularly rapidly.

But rent indexation is not automatic.

The landlord has the option of indexation but is not obliged to do so and must comply with the relevant conditions.

● check that your landlord is indeed complying with the conditions governing indexation;

● if you are a tenant and are struggling to pay your rent, speak to your landlord to try to find an amicable solution. If you've been a good tenant over the years, perhaps they’d be willing to make a gesture of goodwill.


Increases in rental charges

Rising energy costs may have repercussions on the extra charges applied by your landlord. It all depends on what is specified in the tenancy agreement.

● If you pay a fixed charge:

the landlord cannot demand more from you. Fixed charge agreements are made at the risk of each party. However, you (or your landlord) can ask a court to adapt the amount of a fixed charge or to convert it in line with the actual costs if this is justified (change of family composition, absences, etc.).

● If you pay an estimated provision:

the landlord is required to produce a statement and to justify the level of these payments in relation to the tenant's actual usage. They must deduct the amounts already paid by the tenant towards these charges.

In the event of any surplus, the tenant and the landlord can agree to change the estimated provision for bills and other charges. If agreement is reached, an amendment can simply be made to the tenancy agreement, but in the event of any dispute, you can apply to the courts for a ruling to be made.

If your tenancy agreement commenced after 1 January 2018, you should check whether the charges being applied by the landlord actually match those stipulated in the agreement.

Problems paying your energy bills

● check your energy contract.

● contact your supplier without delay. In the event of payment difficulties, energy suppliers are often willing to work with you to find solutions, such as a payment plan or a payment delay.

● consult the websites of the bodies that provide assistance with energy bills:
            o the CREG (Commission for Electricity and Gas Regulation).Via a search, you can see   clearly how your current energy contract compares with the latest offers available on the market. https://www.creg.be/en  - https://www.creg.be/fr/cregscan#/

● check whether you're eligible for the social tariff, a measure designed to help persons who find themselves in social or financial difficulty. https://apps.digital.belgium.be/forms/show_/economie/soctar?lng=fr&cnr

Generally speaking, if you fall into one of the categories for receipt of this subsidised tariff https://www.creg.be/en - https://www.creg.be/fr/consommateur/tarifs-et-prix/tarif-social, it will be applied to your bills automatically, as the FPS Economy keeps the energy companies informed of which customers should benefit from the social tariff. So in theory, you shouldn't have to do anything.

Uw dagelijkse uitgaven worden duurder als gevolg van de inflatie. Overal gaan de prijzen door het dak: gas- en elektriciteitsfacturen, indexering van de huurprijzen, huurlasten, de prijs van brandstoffen enz. De Expat Welcome Desk heeft tips om deze uitgaven op te vangen!

Sterke indexering van de huurprijzen

Dit jaar verhoogt de huur aanzienlijk door de inflatie.

De indexering van de huurprijzen is geen automatisch mechanisme. 

Eigenaars mogen onder bepaalde voorwaarden de huur indexeren maar ze hoeven dit niet te doen.

  • Ga na of de eigenaar voldoet aan de voorwaarden om de huur te indexeren;

  • Als u het moeilijk hebt om de huur te betalen, ga dan de dialoog aan met de eigenaar om een oplossing in der minne te vinden. Misschien is hij wel bereid om een gebaar te stellen als u al jaren een goede huurder bent.

Verhoging van de huurlasten

De toename van de energiekost kan gevolgen hebben voor de huurlasten. Alles hangt af van wat in de huurovereenkomst vermeld staat.  

·       Als u een forfait betaalt

Dan mag de eigenaar u geen toeslag aanrekenen. De betaling van het forfait gebeurt op het risico van elke van de partijen. Wel kunt u (of de eigenaar) de vrederechter verzoeken het forfaitbedrag aan te passen of dit om te zetten in de reële kostprijs van de lasten als dat verantwoord is (nieuwe gezinssamenstelling, afwezigheden…).

·       Als u provisies betaalt:

Dan is de huisbaas verplicht een afrekening op te maken en de uitgaven te verantwoorden aan de hand van het reëel verbruik van de huurder. Daarbij trekt hij de bedragen die de huurder al betaald heeft af van het eindbedrag van de afrekening. 

Als het een dure afrekening betreft, kunnen de huurder en de huiseigenaar onderling overeenkomen het provisiebedrag aan te passen. Komen ze tot een akkoord, dan is het aangewezen om dit op te nemen in een aanhangsel bij de huurovereenkomst. Slaagt u er niet in overeen te komen, dan kunt u zich steeds richten tot de vrederechter.

Is uw huurovereenkomst gesloten na 1 januari 2018, controleer dan of de lasten die de eigenaar aanrekent, overeenstemmen met de bedragen die hiervoor in de overeenkomst vermeld staan.

Hebt u het moeilijk om de energiefacturen te betalen?

  • Zoek dan even uw energiecontract op.
  • Neem zo snel mogelijk contact op met uw energieleverancier. Als u kampt met betalingsmoeilijkheden zijn energieleveranciers vaak bereid om samen met u naar oplossingen te zoeken, bijvoorbeeld in de vorm van gespreide betalingen of betalingsuitstel. 
  • Ga eens kijken op de websites van de officiële structuren die bijstand verstrekken voor alles wat energie aangaat:

                   ***De CREG (Commissie voor de Regulering van de Elektriciteit en het Gas) U kunt er een scan uitvoeren om uw energiecontract te vergelijken met het bestaande marktaanbod. Zo ziet u onmiddellijk waar uw contract zich verhoudt tot de hedendaagse energieprijzen. https://www.creg.be/nl/cregscan#/


 

Als u tot één van de categorieën behoort die recht hebben op het sociaal tarief (https://www.creg.be/nl/consument/prijzen-en-tarieven/sociaal-tarief) wordt dit doorgaans automatisch op uw facturen toegepast. De FOD Economie laat de energieleveranciers immers weten wie van hun klanten recht heeft op het sociaal tarief. In theorie hoeft u hiervoor zelf dus niets te ondernemen.

Indexation des loyers importante 

Cette année l’indexation du loyer est particulièrement élevée suite à l’inflation.

Rappelons que l’indexation du loyer n’est pas automatique. 

Le propriétaire peut indexer mais n’est pas obligé de le faire. Pour indexer, il doit respecter des conditions.

  • Si en tant que locataire vous avez des difficultés pour payer le loyer, dialoguer avec le propriétaire pour trouver une solution amiable. Peut-être qu’il sera prêt à faire un geste si vous avez été un bon locataire durant toutes ces années.

Augmentation des charges 

L’augmentation du coût de l’énergie peut avoir des répercussions sur les charges. Tout dépend ce qui est prévu dans le contrat de bail.  

·       Si vous payez un forfait : 

Le propriétaire ne peut pas vous réclamer de supplément. Le paiement sous forme de forfait se fait aux risques et périls de chacun. Par contre, vous (ou votre propriétaire) pouvez demander au juge de paix d'adapter le montant du forfait ou de le transformer en charges réelles si cela se justifie (changement de composition de famille, absences…).

·       Si vous payez des provisions :

Le propriétaire est tenu de faire un décompte et de justifier les dépenses concernant les consommations réelles du locataire. Il déduit les sommes déjà payées par le locataire pour ses charges. 

En cas de décompte important, le locataire et le propriétaire peuvent convenir de changer le montant des provisions de charges. En cas d'accord, l'idéal est de le prévoir dans un avenant au contrat de bail. Si vous n'arrivez pas à vous accorder, vous pouvez vous adresser au juge de paix.

Si votre contrat de bail a été conclu à partir du 1er janvier 2018, vérifiez si les charges facturées par le propriétaire correspondent bien aux charges annoncées dans le contrat.

Difficultés pour payer les factures d’énergie 

  • Vérifier votre contrat d’énergie.
  •  Contactez votre fournisseur rapidement. En cas de difficultés de paiement, les fournisseurs d'énergie sont souvent disposés à chercher des solutions avec vous, par le biais d’un plan d’échelonnement ou d’un report de paiement. 
  • Se renseigner auprès des structures d’aide pour l’énergie sur les sites internet :

·       Vérifier si vous êtes éligible au tarif social qui est une mesure destinée à aider les personnes se trouvant dans une situation sociale ou financière difficile.

De manière générale, si vous appartenez à une des catégories bénéficiaires de ce tarif

automatiquement appliqué à vos factures. En effet, le SPF Économie fait savoir aux fournisseurs quels sont les clients qui peuvent bénéficier du tarif social. En théorie, il n'y a donc aucune démarche à effectuer de votre côté.
