The registration of your car in Belgium

Many expats arrive in Belgium with their car and are then slow to start the registration process. Be aware that this delay can have consequences and cause you problems! You may receive a fine, fail to obtain a residents parking permit, or even have your vehicle impounded! The Expat Welcome Desk explains the procedure…

Principle

As soon as you have become a resident in Belgium – in other words, when you have obtained a Belgian residence permit from the commune (E, F or A card) – you are required to register your vehicle in Belgium, even if it has already been registered abroad.

Remember that you are required to register in your commune when you stay for more than three months in Belgium. In view of the length of time that this process will take, it is reasonable to suppose that you will have between 6 and 12 months to register your vehicle. Nevertheless, to avoid any problems, you should start the vehicle registration process as soon as you have received your Belgian residence permit!

Exceptions

In some circumstances, you are not required to register a vehicle in Belgium if it is already registered abroad, as illustrated in the following examples:

  • The vehicle is used by an individual for his or her profession (and secondarily for private use) and is provided by a foreign company to which this individual is contracted. In this case, a copy of the employment contract must be kept in the vehicle, together with a document from the foreign employer stating that the vehicle has been provided for this individual.
  • The vehicle is provided free of charge to a person who is resident in Belgium for a maximum period of one month. In this case, the vehicle should carry a document issued by the foreign owner giving authorisation for use of the vehicle for a fixed period ending on a certain date.
  • The vehicle is used by a student during the period of his or her studies. In this case, an up-to-date enrolment certificate issued by the college or education centre must be carried in the vehicle.

Procedure

In order to register your imported vehicle in Belgium, you should:

1.      Gather together all the original vehicle documents: European conformity certificate, foreign registration certificate and the purchase invoice of the vehicle.

2.      Go to a Customs Office (Bureau des Douanes/ Douanekantoor) and ask for the (pink) registration request form with its “705” sticker (green) which details your vehicle characteristics. This form will be stamped and completed at the customs office.

3.      You should then go to a vehicle technical inspection centre (contrôle technique/technische controle).

4.      Contact your insurance broker or insurance company and take out a Belgian public liability insurance policy.

5.      Lastly, request registration of your imported vehicle at the Vehicle Registration Service (DIV) office. This request can be made by you or your insurer.

Taxes

Once your vehicle has been registered in Belgium, certain taxes will be due, notably the initial registration tax and the annual road tax. The initial registration tax is levied only once after you have received your Belgian number plates. It is calculated on an official price scale based on the type of car. The road tax is levied annually on all registration-number holders and the amount is based on engine power.

Important points

  • If your vehicle is not registered in Belgium, the commune will not give you a residents parking permit. This permit gives you the right to park free of charge in your neighbourhood.
  • In Belgium, your vehicle must pass a technical inspection every year. There are many inspection centres, so you can choose the one nearest to you.
  • If you are caught without vehicle registration you will be fined and ordered to register your vehicle immediately. In certain cases, your vehicle could be impounded, and you will incur additional costs to recuperate it!

Heel wat expats komen in België aan met hun voertuig en stellen de formaliteiten voor de inschrijving van het voertuig in België uit. Dit kan onaangename gevolgen hebben: boete, inbeslagname van het voertuig, geen bewonerskaart! Deze toestand leidt dus al eens tot problemen. Het principe

Van zodra iemand zich als bewoner in België vestigt en dus van de gemeente een Belgische verblijfsvergunning heeft verkregen, (kaart E, F, A, …) is deze persoon verplicht zijn voertuig in België in te schrijven, ook al staat dit al in het buitenland geregistreerd.

We brengen hierbij in herinnering dat u verplicht bent zich in te schrijven bij uw gemeente als u langer dan drie maanden in België verblijft.  Gezien de lange inschrijvingsprocedure mag u ervan uitgaan dat u redelijkerwijs beschikt over een termijn van 6 maanden tot een jaar om uw voertuig in te schrijven. Maar om problemen te voorkomen is het een goed idee om de eerste stappen te zetten voor de inschrijving zodra u beschikt over uw Belgische verblijfsvergunning!

Uitzondering

In een aantal gevallen is de inschrijving van buitenlandse voertuigen in België niet verplicht.

Dat is bijvoorbeeld het geval voor:

  • Het voertuig dat een natuurlijke persoon gebruikt bij de uitoefening van zijn beroep (en nu en dan ook voor persoonlijk gebruik) en ter beschikking wordt gesteld door een buitenlands werkgever waarmee deze persoon middels een arbeidsovereenkomst een band heeft. In dat geval dient het voertuig steeds een kopie van deze arbeidsovereenkomst aan boord te hebben, alsook een document opgesteld door de buitenlandse werkgever waaruit blijkt dat deze het voertuig ter beschikking heeft gesteld van de persoon in kwestie.
  • Het voertuig dat kosteloos ter beschikking is gesteld van een persoon die in België woont gedurende een periode van hoogstens een maand. In dat geval dient het voertuig steeds een document van de buitenlandse werkgever aan boord te hebben waaruit blijkt dat deze de toestemming verleent om van het voertuig gebruik te maken tijdens een welomschreven periode, met vermelding van de einddatum.
  • Het voertuig dat gebruikt wordt door een student tijdens diens studies. In dat geval dient het voertuig steeds het attest van eerste inschrijving in de onderwijsinstelling aan boord te hebben.

Procedure

Om uw voertuig in te schrijven, volstaat het: 

1.       Alle originele documenten van het voertuig samen te brengen: het Europees Gelijkwaardigheids­attest, het buitenlands inschrijvingsattest, de eventuele factuur van het voertuig.

2.       Naar het Douanekantoor te gaan om er het (roze) formulier ‘Aanvraag tot inschrijving’ af te halen, voorzien van een « vignet 705 » (met een groene kleur), waarop de kenmerken van het voertuig staan vermeld.  Het formulier moet ter plaatse volledig worden ingevuld en voorzien van een stempel.

3.       Langs te gaan bij de technische controle.

4.       Bij een verzekeringsagent of -maatschappij langs te gaan om er een Belgische verzekering « Burgerlijke aansprakelijkheid » te sluiten.

5.       De inschrijvingsaanvraag in te dienen bij de DIV (Dienst Inschrijving Voertuigen). Deze aanvraag mag worden ingediend door uw verzekeraar of door uzelf.

Belastingen

Zodra een voertuig in België is ingeschreven, zijn ook een aantal belastingen verplicht zoals de belasting op de inverkeerstelling en de jaarlijkse verkeersbelasting. De belasting op de inverkeerstelling is eenmalig verschuldigd bij de aanschaf van de Belgische nummerplaat. Ze wordt berekend aan de hand van officiële tariefschalen die voor elk type voertuig zijn vastgesteld. De verkeersbelasting is jaarlijks verschuldigd. Het bedrag van deze belasting hangt af van het vermogen van het voertuig en geldt voor elke houder van een inschrijvingsnummer.

Opgelet

  • Als uw voertuig niet in België is ingeschreven, reikt uw gemeente geen bewonerskaart uit. Met die kaart kunt u gratis parkeren binnen de zone rond uw woning.
  • In België is de technische controle van uw voertuig een jaarlijkse verplichting. Vergeet dus niet tijdig langs te gaan bij één van de technische controlestations.
  • Als u betrapt wordt op het ontbreken van een inschrijving krijgt u een boete, samen met het dwingend advies om uw voertuig zo snel mogelijk in te schrijven. In bepaalde gevallen kan het voertuig zelfs in beslag worden genomen, wat kan leiden tot bijkomende kosten wanneer u dit wenst te recupereren.

De nombreux expats arrivent en Belgique avec leur voiture et tardent souvent avant de procéder aux formalités d’immatriculation belges. Principe

Dès qu’une personne est résidente en Belgique, c’est-à-dire a obtenu un titre de séjour belge de la commune (carte E, F, A, …) elle a l’obligation d’immatriculer son véhicule en Belgique même si celui-ci est déjà immatriculé à l’étranger.

Rappelons ici qu’il est obligatoire de s’inscrire auprès de votre commune lorsque vous séjournez plus de 3 mois en Belgique.  Tenant compte de la longueur de la procédure d’inscription, on peut considérer qu’un délai de 6 mois à 1 an est raisonnable pour vous laisser le temps d’immatriculer votre véhicule. Ceci dit, afin d’éviter les ennuis pensez à entamer les démarches d’immatriculation dès que vous avez reçu votre titre de séjour belge !

Exception

Dans certains cas, l’immatriculation en Belgique des véhicules immatriculés à l’étranger n’est pas obligatoire.

C’est par exemple le cas pour :
  • Le véhicule qu’une personne physique utilise dans l’exercice de sa profession (et accessoirement à titre privé) et qui est mis à disposition par un employeur étranger auquel cette personne est liée par un contrat de travail. Dans ce cas, une copie du contrat de travail doit se trouver à bord du véhicule, ainsi qu’un document établi par l’employeur étranger montrant que celui-ci a mis le véhicule à disposition de cette personne.
  • Le véhicule qui est mis à disposition à titre gratuit pour une personne résidente en Belgique pendant une période maximum d’un mois. Dans ce cas, un document établi par le titulaire étranger montrant qu’il donne autorisation d’utiliser le véhicule pendant une période déterminée avec mention de la date de fin, doit se trouver à bord du véhicule.
  • Le véhicule utilisé par un étudiant pendant la durée de ses études. Dans ce cas, l’attestation de sa dernière inscription dans l’établissement d’enseignement doit se trouver à bord du véhicule.


Procédure

Afin d’immatriculer votre véhicule il convient de : 

1.       Se munir de tous les documents originaux du véhicule : certificat de conformité européen, certificat étranger d’immatriculation, facture éventuelle du véhicule.

2.       Se rendre au Bureau des Douanes afin d’y demander le formulaire (rose) de demande d’immatriculation apposé d’une « vignette 705 » (de couleur verte) qui reprend les caractéristiques du véhicule.  Un cachet sera apposé sur ce formulaire qui sera dûment complété sur place.

3.       Se rendre au contrôle technique.

4.       Se rendre chez son courtier ou sa compagnie d’assurance pour souscrire une assurance belge « responsabilité civile ».

5.       Introduire la demande d’immatriculation auprès de la DIV (Direction Immatriculation des Véhicules). Cette demande peut être faite par votre assureur ou par vous-même.

 
 Taxes

Une fois que votre véhicule est immatriculé en Belgique, certaines taxes sont obligatoires, comme la taxe de mise en circulation et la taxe annuelle de circulation. La taxe de mise en circulation est exigée une seule fois lors de l’acquisition de la plaque belge. Elle est calculée à l’aide d’échelles tarifaires officielles fixes par type de voiture. La taxe de circulation est annuelle. Son montant est évalué en fonction de la puissance de la voiture et est exigée à tout titulaire d'un numéro d'immatriculation.

 
Attention

  • Si votre véhicule n’est pas immatriculé en Belgique, la commune ne vous délivrera pas de carte riverain. Celle-ci vous octroi le stationnement gratuit dans le secteur de votre domicile.
  • En Belgique, le contrôle technique du véhicule doit se faire annuellement. Pensez à vous rendre au contrôle technique le plus proche.
  • Si vous êtes pris en défaut d’immatriculation une amende vous sera infligée avec l’injonction d’immatriculer votre véhicule au plus vite. Dans certains cas, le véhicule pourrait être saisi, ce qui engendrera des frais supplémentaires pour récupérer ce dernier.
