How to resolve a dispute with your landlord

You have a problem in your apartment and despite several attempts, your landlord doesn’t react. What are your rights? What legal steps can you take to resolve the issue? Can you block payment of the rent? The Expat Welcome Desk explains below…

Is the work in contention my responsibility or the landlord’s?

First of all, it is important to distinguish between work that has to be carried out by the landlord and work that is the responsibility of the tenant. To help us, the Brussels government has published a “non-exhaustive list of maintenance and repairs” summarising the responsibilities of the tenant and landlord.

If the work is your responsibility, you alone have to pay all the costs relating to it.

Can I stop paying the rent or reduce it?

If the work is the responsibility of the landlord and he or she does not do it, in principle you may not stop paying rent or even reduce it.

The payment of rent is one of the principal obligations of the tenant. If the rent is not paid, the owner can ask the local magistrate to end the contract with the tenant at fault.

You must therefore be extremely careful before deciding to stop the rent or a part of it, and take specific precautions.

-          Send a formal notice to your landlord summarising the issue and requesting that he makes the necessary repairs within a certain period of time; warn him that if he fails to do the work within xx days, you will no longer pay the whole rent.

-          The rent reduction must be proportional to the failings of your landlord (for example, reducing the rent by a quarter if one quarter of the apartment surface is unusable due to flooding).

-          Place the unpaid rent in a special account (a blocked account with a bank or lawyer) and tell your landlord. This will show that you intend to pay the money as soon as he has fulfilled his obligations.

How to initiate proceedings with a justice of the peace

If no amiable solution can be found with your landlord, you can turn to the justice system. To do this, you should file an application with the justice of the peace for the area in which the rented property is situated. A lawyer is not mandatory but is strongly recommended if you do not speak one of the national languages fluently.

The application is a written document that must be filed with the court administration. It does not have to follow any particular format but it must include the following elements:

-          the date;

-          the identity of the applicant: name, first name(s), address and national identity number;

-          the identity of the person to be summoned (the opposing party): name, first name(s), address and national identity number;

-          explanation of the request and the reasoning;

-          the judge hearing the case;

-          signature (yours or your lawyer’s).

We draw your attention to the fact that court administrations have certain standard application forms that you can complete.

You must also attach to the application a residence certificate of the person you are taking to court. It can be obtained from the commune in which this person is domiciled and must be dated no more than 15 days prior to the application. If you don’t know where your landlord is domiciled, you should contact a lawyer or court bailiff.

When you file the application and residence certificate with the administration of the justice of the peace, you will be required to pay certain fees in cash. The justice of the peace will then summon the other party by registered mail.

Before filing a court application, we recommend that you send a letter of notice to the landlord formally requesting him to fulfil his obligations. You must of course keep proof of this letter (receipt of the registered letter and copy of the letter sent).

Please note: if your landlord is a legal entity (a company, not-for-profit organisation, administration, etc.), you cannot in principle file an application. Instead you should ask a court bailiff to prepare a summons.


Are there other ways of resolving conflicts?

Yes! The alternatives of mediation and conciliation are often advisable before starting a process with a justice of the peace.

Mediation is a confidential and totally voluntary mechanism in which the parties find equitable settlements through the intervention of a neutral and impartial third party (the mediator) who helps to restore dialogue. This (fee-based) procedure is only possible if both parties agree, although each party is free to end it at any time.
Mediation leads to the signature of a mediation protocol: a written, dated agreement containing certain mandatory legal points, signed by the parties and the mediator, which acknowledges consent.


The conciliation procedure is free and voluntary but unlike mediation, it does not require the agreement of both parties to be initiated. Consequently, a tenant may ask the justice of the peace for conciliation by means of a simple letter. It is not necessary to take a lawyer. On the other hand, the other party is not bound to take part or to reach an agreement with you.


Your letter should mention:

- your name, first name(s) and address;

- the name, first name(s) and address of the person you wish

   to invite to conciliation;

- the issue between you and your request;

- your wish to attempt conciliation.


If conciliation results in an agreement, the judge writes a conciliation report in which the agreement is defined. This report carries the same weight as a court judgement. If either of you does not abide by it, the other can enforce it by for example, contacting a court bailiff.

If conciliation does not result in an agreement, or if one of the parties does not participate, the judge issues a report of non-conciliation.

Hoe regelt u een geschil met de huisbaas ?

Ben ik zelf verantwoordelijk voor de omstreden werken of is hiervoor mijn huisbaas aansprakelijk ?

Eerst en vooral moet duidelijk zijn welke werken ten laste zijn van de eigenaar en voor welke werken de huurder instaat. Daartoe publiceerde de Brusselse Regering een « Lijst met de verdeling van de onderhouds- en reparatieverplichtingen tussen huurder en verhuurder » waarin precies staat aangegeven wie welke kosten draagt.

Bent u verantwoordelijk voor de werken, dan dient u ook als enige de kosten hiervoor te dragen.

 

Mag ik de betaling van de huur stopzetten of het bedrag verminderen ?

Als de werken voor rekening van de eigenaar zijn maar hij deze niet uitvoert, dan mag u de betaling van de huur in principe niet onderbreken of het huurbedrag verminderen.

Het betalen van het huurgeld is immers één van de voornaamste plichten van de huurder. Betaalt deze de huur niet, dan kan de eigenaar de vrederechter verzoeken het contract ten laste van de in gebreke blijvende huurder te verbreken.

Neem daarom alvast een aantal voorzorgen vóór u beslist niet langer de huur te betalen of een deel hiervan in te houden:

·         Stuur een brief naar de eigenaar waarin u deze in gebreke stelt door de vastgestelde problemen te vermelden en hem te verzoeken binnen een welbepaalde termijn de nodige herstellingen uit te voeren; maak ook duidelijk dat indien hij de werken niet uitvoert binnen de xx dagen, u niet langer de volledige huurprijs zal betalen.

·         De vermindering van de huurprijs moet in verhouding staan tot de tekortkoming van de eigenaar (bijvoorbeeld een vermindering met een vierde als een vierde van de oppervlakte onbruikbaar is geworden als gevolg van een waterlek).

·         Stort de onbetaalde huurgelden op een speciale rekening (rekening geblokkeerd bij de bank of bij een advocaat) en stel uw huisbaas hiervan op de hoogte. Daarmee toont u aan dat u bereid bent de bedragen door te storten zodra hij aan zijn verplichtingen voldaan heeft.


Hoe leidt u een procedure in bij de vrederechter ?

Als met de eigenaar geen minnelijke schikking mogelijk blijkt, kunt u naar de rechtbank. Daartoe dient u een verzoekschrift in bij de vrederechter van de gemeente waar het gehuurde onroerend goed is gelegen. Een advocaat is daarbij niet verplicht maar blijft wel aangeraden als u de landstalen niet goed beheerst.

Een verzoekschrift is een document dat moet worden ingediend op de griffie van de rechtbank. Het hoeft niet aan bepaalde vormvereisten te voldoen, maar moet verplicht melding maken van de volgende elementen:

·         De datum;

·         De identiteit van de indiener: naam, voornaam, woonplaats en rijksregisternummer;

·         De identiteit van de persoon die moet worden opgeroepen (de tegenpartij): naam, voornaam, woonplaats en rijksregisternummer;

·         De toelichting van het verzoek en van de bewijsgronden;

·         De rechter bij wie de zaak aanhangig wordt gemaakt;

·         De handtekening (van uzelf of van uw advocaat).

Wij geven u alvast mee dat er op de griffie modellen van verzoekschriften beschikbaar zijn die u alleen maar hoeft in te vullen.

Aan het verzoekschrift moet ook het bewijs van woonst worden toegevoegd van de persoon die u voor de rechtbank daagt. Dit mag niet meer dan 15 dagen oud zijn. Voor dit document kunt u terecht op de gemeente waar de betrokkene woont. Kent u de woonplaats van uw huisbaas niet, dan dient u een beroep te doen op een advocaat of een gerechtsdeurwaarder.

Bij de indiening van het verzoekschrift met bewijs van woonst op de griffie van het vredegerecht dient u contant bepaalde kosten te betalen. Vervolgens roept de griffie per aangetekend schrijven de tegenpartij op.

Vóór u naar de rechtbank stapt, raden wij u aan de eigenaar per brief in gebreke te stellen met het verzoek onmiddellijk aan zijn plicht te voldoen. Van dit schrijven houdt u uiteraard een verzendingsbewijs bij (reçu van de aangetekende zending en kopie van de verstuurde brief).

Opgelet, is de tegenpartij een rechtspersoon (een bedrijf, een vzw, een administratie e.d.), dan kunt u in principe geen verzoekschrift indienen. In zo’n geval neemt u contact op met een gerechtsdeurwaarder zodat deze een dagvaarding kan opstellen.

Bestaan er alternatieven om geschillen op te lossen ?

Ja, vaak worden bemiddeling en verzoening aangeraden als alternatieven voor een procedure bij de vrederechter.

Bemiddeling is een vertrouwelijk en volledig vrijwillig mechanisme waarbij de partijen billijke oplossingen vinden dankzij het optreden van een neutrale en onpartijdige derde (de bemiddelaar) die de dialoog herstelt. Deze procedure (waarvoor betaald dient te worden) is enkel mogelijk als beide partijen hiertoe bereid zijn en het staat elke partij vrij ze op ieder moment af te breken.

De bemiddeling leidt tot de ondertekening van een bemiddelingsprotocol. Dit is een schriftelijke en gedateerde overeenkomst die een aantal wettelijk verplichte elementen vermeldt en die ondertekend wordt door de beide partijen en de bemiddelaar, die akte neemt van de overeenstemming.

De verzoeningsprocedure is kosteloos en vrijwillig. In tegenstelling tot de bemiddelingsprocedure vereist zij niet de instemming van beide partijen om te worden « ingeleid ». De huurder kan dan ook met een eenvoudige brief een verzoek tot verzoening richten tot de vrederechter. Een advocaat is daarbij niet nodig. Anderzijds is de tegenpartij niet verplicht om te verschijnen of met u tot overeenstemming te komen.

Uw brief moet de volgende elementen vermelden:

-          Uw naam, voornaam en adres;

-          De naam, voornaam en het adres van de persoon die u tot verzoening uitnodigt;

-          Het probleem dat aan de basis ligt van het geschil en uw verzoek;

-          U wens om tot verzoening te komen.

Leidt de verzoening tot een akkoord, dan stelt de rechter een proces-verbaal op waarin het akkoord vervat wordt. Dit proces-verbaal heeft de waarde van een vonnis. Indien één van beiden het akkoord niet naleeft, dan kan de andere partij hem hiertoe dwingen, bij voorbeeld door een beroep te doen op een gerechtsdeurwaarder.

Leidt de verzoening niet tot een akkoord of is één van de partijen niet verschenen, dan stelt de rechter een proces-verbaal op dat stelt dat er geen verzoening is.

Les travaux objets du litige relèvent-ils de ma responsabilité ou de celle de mon propriétaire ?
Avant tout, il est important de déterminer les travaux qui sont à charge du propriétaire ou du locataire. Pour ce faire, le Gouvernement bruxellois a publié une « liste non-limitative des réparations et travaux d’entretien » reprenant les charges qui incombent au preneur ou au bailleur.

Si les travaux relèvent de votre responsabilité, vous devrez supporter seul tous les frais qui y sont relatifs.


Puis-je cesser de payer mon loyer ou le diminuer ?

Si les travaux sont à charge du propriétaire et que celui-ci ne les réalise pas, vous ne pouvez en principe pas arrêter de payer votre loyer ni même le diminuer.

En effet, le paiement du loyer est l’une des obligations principales du locataire. Si le loyer n’est pas payé, le propriétaire peut demander au juge de paix de rompre le contrat aux torts du locataire fautif.

Il faut donc être très prudent avant de décider de ne plus payer le loyer en tout ou en partie et prendre certaines précautions :

·         Envoyez une lettre de mise en demeure à votre propriétaire en lui résumant les problèmes rencontrés et en lui demandant de faire les réparations nécessaires dans un certain délai ; prévenez-le que s'il ne fait pas les travaux endéans les xx jours, vous ne paierez plus l’entièreté du loyer.

·         La réduction du loyer doit être proportionnelle aux manquements de votre propriétaire (par exemple, une réduction d’un quart du loyer si un quart de la surface du logement est inutilisable suite à une fuite d'eau).

·         Placez les loyers impayés sur un compte spécial, (compte bloqué en banque ou chez un avocat) et prévenez votre propriétaire. Cela démontre votre intention de les lui remettre dès qu'il aura exécuté ses obligations.

Comment introduire une procédure devant le juge de paix ?

Si aucune solution amiable ne peut être trouvée avec votre propriétaire vous pouvez vous tourner vers la justice. Pour ce faire, vous devez introduire une requête devant le juge de paix du lieu où est situé le bien loué. Un avocat n’est pas obligatoire mais reste vivement conseillé si vous ne maitrisez pas les langues nationales.

La requête est un document écrit qu'il faut déposer au greffe. Elle ne doit pas revêtir de forme particulière, mais elle doit mentionner obligatoirement les éléments suivants :

·         La date;

·         L’identité de celui qui fait la demande : nom, prénom (s), domicile et numéro de registre national;

·         L’identité de la personne à convoquer (la partie adverse) : nom, prénom (s), domicile et son numéro de registre national;

·         L’explication de la demande et les arguments;

·         Le juge saisi;

·         La signature (la vôtre ou celle de votre avocat).

Nous attirons votre attention sur le fait qu’il existe au greffe certains modèles de requête-type que vous pouvez compléter.

Il faut joindre à la requête le certificat de domicile de la personne qu'on veut amener en justice. Il doit dater de moins de 15 jours. Pour obtenir ce certificat, il faut se rendre à la commune du domicile de cette personne. Si vous ne connaissez pas le domicile de votre propriétaire, vous devez faire appel à un avocat ou un huissier.

Lorsque vous déposez la requête et le certificat de domicile au greffe de la justice de paix, vous devez payer certains frais en liquide. Ensuite, le greffe convoque l'autre partie par courrier recommandé.

Avant d'introduire une demande en justice, nous vous recommandons d’envoyer une lettre de mise en demeure au propriétaire lui demandant formellement d’exécuter son obligation. Il faut bien évidemment conserver une preuve de cet envoi (récépissé du recommandé et copie de la lettre envoyée).

Attention, si votre adversaire est une personne morale (une société, une asbl, une administration, etc.), vous ne pouvez en principe pas déposer de requête. Vous devez vous adresser à un huissier de justice pour qu'il rédige une citation.

Existe-t-il des modes alternatifs de résolution des conflits ?

Oui, la médiation et la conciliation sont des alternatives souvent conseillées avant d’introduire une procédure devant le juge de paix.

La médiation est un mécanisme confidentiel et totalement volontaire lors duquel les parties trouvent des solutions équitables grâce à l’intervention d’un tiers neutre et impartial (le médiateur) qui contribue à rétablir le dialogue. Cette procédure (payante) n’est possible que si les deux parties sont d’accord mais chacun est libre d’y mettre fin à tout moment.

La médiation débouche sur la signature d’un protocole de médiation à savoir une convention écrite, datée, reprenant certaines mentions légales obligatoires et signée par les parties et le médiateur qui acte le consentement.

La procédure de conciliation est gratuite et volontaire et contrairement à la médiation elle ne requiert pas l’accord des deux parties pour être « introduite ». Dès lors, le locataire peut adresser une demande de conciliation au juge de paix par simple lettre. Il n’est pas nécessaire de prendre un avocat. Par contre, l’autre partie n'est pas obligée de se présenter, ni de trouver un accord avec vous.

Votre courrier doit mentionner :

-          Vos nom, prénom (s) et adresse;

-          Les nom, prénom(s) et adresse de la personne que vous souhaitez inviter en conciliation;

-          Le problème qui vous oppose et votre demande;

-          Votre souhait de tenter une conciliation.

Si la conciliation aboutit à un accord, le juge rédige un procès-verbal de conciliation dans lequel il reprend l'accord. Ce procès-verbal a la même valeur qu’un jugement. Si l'un de vous ne le respecte pas, l'autre pourra le forcer à le faire en faisant par exemple appel à un huissier.

Si la conciliation n’aboutit pas à un accord, ou si une des parties ne s’est pas présentée, le juge dresse un procès-verbal de non-conciliation.
