Do you want to be your own boss and start a self-employed activity? It’s important to prepare your project carefully and find out about the obligations that self-employment brings. It’s very different from being an employee! The Expat Welcome Desk explains the steps to follow. 1. Before starting your own business, ask yourself some key questions:
What service are you going to offer? Who are your competitors? How are you going to make your services known? Do you need specific authorisation or licenses? What investments do you need to make? What are your tax, bookkeeping and social obligations?
2. Contact a business information centre
A business information centre (guichet d’entreprise in French) is the place to start when you’re looking for answers to your questions. It will also help you with all the formalities related to starting your own business.
There are eight official business information organisations in Belgium, with around 200 centres spread throughout the country. You are free to choose which centre you contact, irrespective of where your business will be.
After checking your basic entrepreneurial skills and experience, the business information centre will register your activity in the national trade registry (Crossroads Bank for Enterprises/Banque-Carrefour des Entreprises). You will then be allocated an enterprise number.
Business information centres also provide other services:
- registration for VAT;
- requests for authorisations & licenses, depending on your activity sector;
- advice on the legal set-up of your project;
- training;
- assistance and support during the first few months of activity.
The centre is free to apply its own charges for these additional services.
3. Join a social security fund
As a self-employed person, you must join a social security fund for the self-employed in order to acquire welfare benefits (family benefits, sickness allowances, pension, etc.).
You will be required to pay quarterly social security contributions to your social security fund.
The calculation of theses social security contributions is made in two phases: a provisional contribution is charged during the year based on your professional self-employed income three years previously, followed by a final adjusted amount based on your actual final income.
You will be required to provide proof from your social security institution that you have made the necessary social security contributions.
5. Contact an accountant
In Belgium, all business activities are in principle required to keep accounts.
Not all companies are bound by the same bookkeeping requirements. Regulations vary depending on the legal constitution (company or individual), number of employees, turnover and balance sheet.
6. Obtain a professional card
If you are not a national of one of the member states of the European Economic Area (countries in the EU plus Iceland, Norway and Liechtenstein) or Switzerland, or you are not married to a EU-citizen, you must hold a professional card to be able to exercise a self-employed activity in Belgium. Belgian regional authorities are responsible for issuing these cards.
You can request a professional card from:
- the official business information centre you have chosen, if you already live in Belgium and hold a valid registration certificate model A or a certificate of entry in the foreign persons register;
- from the Belgian embassy or consulate in your country of residence, if you live abroad.

Dan is het belangrijk dat u het project dat u voor ogen hebt goed voorbereidt en informatie inwint over de plichten die aan dat statuut verbonden zijn, want die verschillen nogal van het werknemersstatuut. 1. Stel alvast de juiste vragen vóór u met uw activiteit van start gaat :
Welke diensten wenst u aan te bieden ? Wie zijn uw concurrenten ? Hoe gaat u deze diensten bekendheid geven ? Hebt u specifieke vergunningen of licenties nodig ? Welke investeringen zijn vereist ? Aan welke fiscale, boekhoudkundige, sociale of andere plichten bent u gehouden ?
2. Neem contact op met een ondernemingsloket
De ondernemingsloketten zijn uw unieke aanspreekpunt om antwoorden te krijgen op de meest uiteenlopende vragen en om de administratieve formaliteiten te vervullen die aan de lancering van uw activiteit verbonden zijn.
Er zijn acht organisaties erkend als ondernemingsloket. Zij beschikken over ongeveer 200 kantoren verspreid over het hele land. U kiest vrij uw ondernemingsloket ongeacht waar uw onderneming gevestigd is.
Als u voldoet aan de wettelijke voorwaarden, registreert het ondernemingsloket uw onderneming bij de Kruispuntbank voor Ondernemingen en schrijft u daar in. Daarbij krijgt u onmiddellijk een ondernemingsnummer toegekend.
Maar het loket biedt ook andere diensten aan zoals :
· Identificatie bij de BTW ;
· Aanvragen voor de machtigingen die zijn verbonden aan uw activiteit ;
· Advies bij de uitwerking van uw project ;
· Opleidingen ;
· Begeleiding tijdens de eerste maanden activiteit, enz.
Voor deze bijkomende diensten mogen de loketten vrij hun tarieven bepalen.
3. Sluit aan bij een verzekeringskas
Als zelfstandig werknemer moet u aangesloten zijn bij een sociaal verzekeringsfonds voor zelfstandigen om aanspraak te kunnen maken op bepaalde rechten van de sociale zekerheid (kinderbijslag, vergoeding bij ziekte, pensioen, …).
Daarna betaalt u driemaandelijks sociale bijdragen aan het sociaal verzekeringsfonds dat u hebt gekozen.
De sociale bijdragen worden berekend in twee fasen : tijdens het jaar betaalt u een voorlopige bijdrage op basis van uw zelfstandige beroepsinkomsten van drie jaar daarvoor en achteraf wordt een eindafrekening gemaakt in functie van uw definitieve beroepsinkomsten.
U wordt daarbij geacht een attest van uw sociaal verzekeringsfonds voor te leggen waaruit blijkt dat u aan uw plichten inzake sociale bijdragen voldaan hebt.
5. Neem contact op met een boekhouder
In België dienen alle ondernemingen in principe een boekhouding te voeren.
Niet alle ondernemingen zijn onderworpen aan dezelfde boekhoudkundige plichten. De wet maakt een onderscheid in functie van de juridische vorm van het bedrijf (vennootschap of natuurlijke persoon), van het aantal tewerkgestelde werknemers, van de omzet en van de balans.
6. Vraag een beroepskaart aan
Bent u geen onderdaan van één van de Lidstaten van de Europese Economische Ruimte (de leden van de Europese Unie plus IJsland, Noorwegen en Liechtenstein) of Zwitserland en bent u niet gehuwd met een EU-burger, dan dient u zich een beroepskaart aan te schaffen om in België een zelfstandige activiteit te kunnen uitoefenen. Het zijn de Gewesten die bevoegd zijn voor de toekenning van de beroepskaarten.
U dient uw aanvraag voor een beroepskaart in :
• bij een erkend ondernemingsloket naar keuze indien u reeds in België woont en beschikt over een geldig « attest van immatriculatie model A » of « bewijs van inschrijving in het vreemdelingenregister » ;
• bij de Belgische diplomatieke of consulaire post van uw land van verblijf indien u in het buitenland woont.

Devenir un travailleur indépendant en Belgique : comment faire?
Vous souhaitez lancer votre activité indépendante et devenir votre « propre patron » ? Il est important de bien préparer votre projet et de vous informer sur les obligations qui découlent de ce statut, très différent de celui d’employé. L’Expat Welcome Desk vous explique les étapes à suivre.
1. Avant de lancer votre activité posez-vous les bonnes questions :
Quels services allez-vous proposer? Quels sont vos concurrents ? Comment allez-vous faire connaître vos services ? Faut-il demander des autorisations ou des licences spécifiques ? Quels investissements faut-il prévoir ? Quelles sont les obligations fiscales, comptables, sociales… ?
2. Contactez un guichet d’entreprise
Les guichets d’entreprises sont votre point d’entrée unique pour trouver une réponse à vos différentes questions et pour effectuer les formalités administratives liées au lancement de votre activité.
Il existe huit organisations agréées en tant que guichet d’entreprises. Les guichets d’entreprises disposent d’environ 200 bureaux répartis dans tout le pays. Vous êtes libre de choisir votre guichet d’entreprises quel que soit le lieu d’établissement de votre entreprise.
Après avoir vérifié vos capacités entrepreneuriales, le guichet d’entreprises procède à l’enregistrement de votre entreprise dans la Banque-Carrefour des Entreprises. Un numéro d’entreprise vous est alors attribué.
Les guichets proposent également d’autres services tels que :
· l’identification auprès de la TVA ;
· la demande de diverses autorisations (en fonction de votre activité) ;
· des conseils lors de la constitution de votre projet ;
· des formations ;
· un accompagnement pendant les premiers mois d’activité, etc.
Pour ces services complémentaires, les guichets sont libres de fixer leurs tarifs.
3. Affiliez-vous à une caisse d’assurance
En qualité de travailleur indépendant, vous devez vous affilier à une caisse d’assurances sociales pour travailleurs indépendants afin de prétendre à divers droits de sécurité sociale (allocations familiales, indemnités en cas de maladie, pension, …).
Vous devrez payer des cotisations sociales trimestrielles à votre caisse d’assurances sociales.
Le calcul des cotisations sociales se réalise en deux phases : une cotisation provisoire est perçue durant l’année sur base de vos revenus professionnels d’indépendant d’il y a 3 ans et un décompte final est ensuite réalisé sur base de vos revenus professionnels définitifs.
Vous devez fournir une attestation en provenance de votre caisse d’assurances sociales qui établit l’accomplissement des obligations en matière de cotisations sociales.
5. Prenez contact avec un comptable
En Belgique, toutes les entreprises doivent, en principe, tenir une comptabilité.
Les entreprises ne sont pas toutes soumises aux mêmes obligations comptables. La loi fait une distinction en fonction de la forme juridique (société ou personne physique), du nombre de travailleurs occupés, du chiffre d’affaires et du total du bilan.
6. Obtenir une carte professionnelle
Si vous n’avez pas la nationalité de l’un des Etats membres de l’Espace économique européen (les pays de l’Union européenne plus l’Islande, la Norvège et le Liechtenstein) ou de la Suisse, et que vous n’êtes pas marié à un citoyen européen, vous devez être en possession d’une carte professionnelle pour pouvoir exercer une activité indépendante en Belgique. Les régions sont compétentes pour l’octroi des cartes professionnelles.
Vous devez introduire votre demande de carte professionnelle :
• auprès du guichet d’entreprises agréé de votre choix, si vous résidez déjà en Belgique et disposez d’une « attestation d’immatriculation modèle A » ou d’un « certificat d’inscription au registre des étrangers », en ordre de validité ;
• auprès du poste diplomatique ou consulaire belge de votre pays de résidence, si vous vivez à l’étranger.
