Annual indexation of rent: how does it work in Belgium?

Every year, the rent for your accommodation may be indexed. Rent indexation, which is strictly regulated by law, adapts rent annually to changes in the cost of living. When will you be indexed? How is it calculated? Can your landlord charge arrears? The Expat Welcome Desk explains all you need to know on the subject…

What is indexation of rent?


Rent is the financial counterpart of the right to occupy property. In general, it is paid monthly by the tenant; more rarely, it may be paid quarterly.

In principle, once the amount of rent has been fixed by the landlord and accepted by the tenant, it cannot be changed during the term of the lease (except in specific circumstances).

On the other hand, rent can be “indexed”, if these two conditions are met:

-          your lease contract is written (or oral if concluded before 31 May 1997);

-          your lease (or amendment to lease) does not exclude indexation.

Rent indexation, which is regulated by law, allows rent to be adjusted annually to the cost of living.

When is indexation applied?

Rent indexation is not automatic; the landlord must notify the tenant in writing on the anniversary date of the start of the lease – in other words, the date when the tenant effectively took possession of the property.

Can my landlord claim arrears for rent indexation?

Your landlord is entitled to claim arrears in rent indexation but only for the three months preceding the request for indexation. Indexation payments prior to this cannot be reclaimed.

Example:

On 18 November 2012, you signed a contract for a lease beginning on 1 December 2012. On 26 September 2015, your landlord sends you a written request to pay indexed rent and also demands indexation arrears from 1 December 2012. In this case, it is permitted to index rent as from 1 December 2015. Concerning the past, your landlord is only entitled to reclaim indexation arrears for June, July and August 2015 (three months preceding the request made on 26 September 2015).

Please note: there is also a limitation period. Your landlord has one year to start legal proceedings if you fail to pay the indexed amount.

How is indexation calculated?

The indexation of your rent is calculated according to a formula fixed by law. Your landlord cannot request higher rent based on a different method.

-          new index = health index of the month preceding the contract anniversary date (date of possession of property).

Please note:

-          The original rent should never include costs and charges due from the tenant. It is therefore important to clearly distinguish between the amount of the rent and the amount of the charges in your lease contract (see also our previous article: “rental charges”).

-          The original index is that of the month preceding the month in which the contract is signed (for all contracts drawn up after 1983).

-          The new index is always the health index of the month preceding the contract anniversary date (and NOT the month preceding the signature anniversary date, unless these two dates are the same).

Do not confuse rent indexation with rent revision!

Rent revision is a real increase or decrease of rent requested by the landlord (or tenant) during the term of the lease.

In principle, the conditions of a lease – including the rent – cannot be changed during the term of the lease!

However, there are two exceptions when the rental value of accommodation may be increased:

-          by at least 10% following renovation work undertaken by the landlord, such as the addition of a veranda for example. Compliancy upgrades such as the urgent treatment of humidity do not qualify!

-          by at least 20% due to new circumstances that make the neighbourhood more attractive, such as the opening of a new school nearby.

In these cases, the tenant and landlord must negotiate the rent revision between the 9th and 6th months preceding the end of a three-year period (in a 9-year lease). In the event of disagreement, they can go to court, but only between the 6th and 3rd month preceding the end of a three-year period.

Please note that a rent is rarely changed during a lease! In the event of a sale or death, the new owner cannot suddenly change the rent. The new landlord must respect the existing contract and follow the strict rules outlined above if he or she wishes to change the rent!

De huur voor uw woning mag jaarlijks geïndexeerd worden. De indexering van de huurprijzen, die wettelijk strikt staat omschreven, maakt het mogelijk de huurprijzen jaarlijks aan de kosten van de levensduurte aan te passen. Wanneer gebeurt de indexering? Hoe wordt de indexering berekend? Mag mijn huisbaas om achterstallige bedragen vragen? De Expat Welcome Desk legt uit wat u hierover moet weten!

Wat is eigenlijk de indexering van de huurprijzen?

Huurgeld is de financiële tegenprestatie voor het recht om een woning te betrekken. Doorgaans betaalt de huurder dit maandelijks, heel soms per kwartaal. 

Zodra de eigenaar de huurprijs heeft bepaald en de huurder deze heeft aanvaard, mag dit bedrag zo lang de huurovereenkomst loopt niet worden gewijzigd, op een paar uitzonderingen na.

De huurprijs mag immers « geïndexeerd » worden als aan twee voorwaarden voldaan is:

·         U hebt een schriftelijke huurovereenkomst (of een mondelinge overeenkomst, maar dan van vóór 31 mei 1997);

·         Uw huurovereenkomst (of een aanhangsel hieraan) verbiedt de indexering niet.

De indexering van de huurprijzen is wettelijk vastgelegd en houdt in dat deze jaarlijks aangepast kunnen worden aan de kosten van het levensonderhoud. 

Wanneer gebeurt de indexering?


De indexering van de huurprijzen gebeurt niet automatisch: de eigenaar dient de huurder schriftelijk op de hoogte te stellen op de verjaardag van de startdatum van de huurovereenkomst, d.w.z. de dag waarop de huurder effectief de beschikking heeft gekregen over de woning.

 

Mag mijn eigenaar achterstallige bedragen eisen op de huurindexering ?



Uw eigenaar mag enkel achterstallige bedragen vorderen voor de drie maanden die aan de vraag om indexering voorafgaan. Voor het overige zijn de indexeringen voor hem verloren.

Een voorbeeld:

Op 18 november 2012 hebt u een huurovereenkomst ondertekend die ingaat op 1 december 2012. Op 26 september 2015 verzoekt de eigenaar u schriftelijk de geïndexeerde huur te betalen en vraagt hij u het indexeringsbedrag sinds 1 december 2012. De indexering berekend op basis van 1 december 2015 is in dat geval toegestaan. Maar voor het verleden mag de huisbaas u enkel vragen uitstaande bedragen te betalen voor de maanden juni, juli en augustus 2015 (de drie maanden die voorafgaan aan de vraag van 26 september 2015).

Opgelet, er bestaat een verjaringstermijn: uw huisbaas heeft een jaar tijd om u voor de rechtbank te brengen indien u de huurindexering niet betaald hebt.

 

Hoe wordt de indexering berekend?


De indexering van uw huurgeld wordt berekend volgens een door de wet vastgestelde formule. Het is uw huisbaas niet toegestaan een hogere huurprijs te vragen op basis van een andere formule.

Basishuur (zonder lasten) x nieuwe gezondheidsindex

Basis-gezondheidsindex

·         Basishuur: huurprijs vermeld in de huurovereenkomst

·         Startindex: gezondheidsindex voor de maand die de ondertekening van de overeenkomst voorafgaat

·         Nieuwe index: gezondheidsindex voor de maand die de verjaardag van de start van de huurovereenkomst voorafgaat (datum waarop de woning is vrijgegeven).

U kunt zelf de indexering van uw huurgeld berekenen op de website van de FOD Economie (http://statbel.fgov.be/nl/statistieken/cijfers/economie/consumptieprijzen/huurcalculator/ ).

Opgelet:

·         In de basishuur mogen nooit de onkosten en lasten begrepen zijn die de huurder verschuldigd is. Het is dan ook belangrijk het bedrag van de huur en dat van de lasten in uw huurovereenkomst duidelijk van elkaar te onderscheiden (zie ook ons artikel over de « huurlasten »).

·         De startindex is het indexcijfer voor de maand die de ondertekening van de overeenkomst voorafging (voor alle contracten die zijn ingegaan na het jaar 1983).

·         De nieuwe index is altijd de gezondheidsindex voor de maand vóór de verjaardag van de start van de huurovereenkomst (en dus NIET de verjaardag van de ondertekening van de overeenkomst, tenzij het om dezelfde datum gaat).

Niet verwarren met de herziening van de huurprijs!

De herziening is een echte verhoging (of vermindering) van de huur, gevraagd door de eigenaar (of de huurder) in de loop van de huurovereenkomst.

In principe mogen de huurvoorwaarden, en dus ook de huurprijs, tijdens de huurovereenkomst niet gewijzigd worden!

Er bestaan echter twee uitzonderingen waarbij de huurwaarde van het eigendom toeneemt:

·         met minstens 10% als gevolg van renovatiewerken uitgevoerd door de eigenaar. Bijvoorbeeld de toevoeging van een veranda. Het mag echter niet gaan om werken om de woning in overeenstemming te brengen met de normen, zoals dringende werken voor vochtverwijdering!

·         met minstens 20% als gevolg van nieuwe omstandigheden die de wijk aantrekkelijker maken. Bijvoorbeeld een nieuwe school in de nabijheid.

De eigenaar en de huurder dienen in dergelijke gevallen te onderhandelen over de herziening van de huurprijs tussen de negende en de zesde maand vóór het einde van een driejarige periode. Komen ze niet tot een akkoord, dan kunnen ze hun geschil aanhangig maken bij de Vrederechter, maar enkel tussen de zesde en de derde maand vóór het einde van de lopende driejarige periode.

Opgelet, aanpassingen van de huurprijs in de loop van de huurovereenkomst zijn zeldzaam! Zo kan een nieuwe eigenaar na een verkoop of overlijden niet onmiddellijk de huur aanpassen. Hij is verplicht de lopende huurovereenkomst na te leven en de strikte regels die hierboven vermeld staan toe te passen indien hij de huurprijs wil herzien!

Qu'est-ce que l'indexation du loyer ?

Le loyer est la contrepartie financière du droit d’occuper un logement. En général, il est payé par le locataire mensuellement, plus rarement tous les trimestres. 

En principe, une fois fixé par le propriétaire et accepté par le locataire, le loyer ne peut plus être modifié en cours de bail, sauf exceptions.

En revanche, le loyer peut être « indexé », si ces 2 conditions sont remplies :

·         Votre contrat de bail est écrit (ou oral, mais avant le 31 mai 1997) ;

·         Votre bail (ou un avenant) n'interdit pas l'indexation.

L’indexation des loyers, qui est encadrée par la loi, permet en effet d’adapter annuellement les loyers au niveau du coût de la vie. 

Quand a lieu l’indexation ?


L’indexation des loyers n’est pas automatique : le propriétaire doit la notifier par écrit à son locataire à la date anniversaire de l’entrée en vigueur du bail, c’est-à-dire la date à laquelle il a effectivement pris possession des lieux.

 

Mon propriétaire peut-il me réclamer des arriérés d'indexation de loyer ?



Votre propriétaire peut réclamer des arriérés uniquement pour les 3 mois précédant le mois de sa demande d'indexation. Pour le reste, les indexations sont perdues.

Par exemple :

Vous avez signé, le 18 novembre 2012, un contrat de bail qui débute le 1er décembre 2012. Le 26 septembre 2015, votre propriétaire vous demande, par écrit, de payer votre loyer tel qu'indexé et vous réclame les arriérés de loyer depuis le 1er décembre 2012. Dans ce cas, l'indexation, calculée sur base du 1er décembre 2015, est permise. Mais, pour le passé, votre propriétaire ne pourra vous réclamer que les arriérés des mois de juin, juillet et août 2015 (trois mois précédant le mois de la demande, soit le 26 septembre 2015).

Attention, il existe aussi un délai de prescription : votre propriétaire a 1 an pour demander votre condamnation en justice si vous n'avez pas payé l'indexation du loyer.

 

Comment calculer l’indexation ?


L’indexation de votre loyer se calcule selon une formule fixée par la loi. Votre propriétaire ne peut pas vous demander un loyer supérieur selon une autre formule.

·         Loyer de base : loyer indiqué dans le contrat

·         Indice de départ : indice santé du mois qui précède la signature du bail

·         Nouvel indice : indice santé du mois qui précède l'anniversaire du début du bail (date de l'entrée dans le logement).

Vous pouvez calculer vous-même l’indexation de votre loyer sur le site du SPF Economie (http://statbel.fgov.be/fr/statistiques/chiffres/economie/prix_consommation/calculateur_loyer/ ).

Attention :

·         Le loyer de base ne peut jamais comprendre les frais et les charges dus par le locataire, d’où l’importance de bien distinguer le montant du loyer et celui des charges dans votre contrat de bail (voir aussi notre article sur « les charges locatives »).

·         L’indice de départ est celui du mois qui précède celui au cours duquel le contrat a été signé (pour tous les contrats entrés en vigueur après l'année 1983).

·         Le nouvel indice est toujours l’indice santé du mois qui précède celui de l’anniversaire de l’entrée en vigueur du bail (donc PAS celui qui précède l'anniversaire de la signature du bail, à moins que ces deux données soient identiques).

Ne pas confondre avec la révision du loyer !

La révision est une réelle augmentation (ou diminution) du loyer, qui est demandée en cours de bail par le propriétaire (ou le locataire).

En principe les conditions du bail et donc le loyer, ne peuvent pas être modifiées en cours de bail !

Il existe cependant deux exceptions quand la valeur locative du bien a augmenté :

·         D’au moins 10% suite à des travaux de rénovation réalisés par le propriétaire. Par exemple l’ajout d’une veranda. Il ne peut pas s’agir de travaux de mise en conformité, comme des travaux urgents de traitement d’humidité !

·         D’au moins 20% suite à des circonstances nouvelles qui rendent le quartier plus attrayant. Par exemple l’ouverture d’une école à proximité.

Le propriétaire et le locataire doivent alors négocier la révision du loyer entre le 9ème et le 6ème mois qui précèdent la fin d’un triennat (période de 3 ans). En cas de désaccord ils pourront saisir le juge de paix mais uniquement entre le 6ème et le 3ème mois précédant un triennat.

Attention, il est rare qu’un loyer soit modifié en cours de bail! Donc en cas de vente ou de décès, votre nouveau bailleur ne pourra pas subitement modifier votre loyer. Il devra respecter le contrat en cours et appliquer les règles strictes énoncées ci-dessus s’il souhaite réviser le loyer !
