An ombudsman: the ideal solution for certain problems!

If you come up against a problem with the administration or an organisation, either in the private or public sector, you can contact the relevant mediator with your complaint. There are different types of ombudsmen, each with their own area of competency: taxation, transport, residence permits, health, postal service, energy, pensions, and so on. Each ombudsman will examine your complaint independently and objectively. And if your complaint is not justified, they will explain the reason to you. What exactly does an ombudsman do and how can you contact one? The Expat Welcome Desk explains below…

Do you believe an error has been made in the treatment of your particular situation…and are you waiting in vain for a response from the authorities… or perhaps you are unable to even reach the service concerned? If so, don’t hesitate to contact the relevant ombudsman, also called a “mediator”.

1.      What is the role of an ombudsman?

An ombudsman deals with a complaint about an administration or organisation which has not been satisfactorily resolved.

An ombudsman:

  • Is Independent;
  • works free of charge;
  • is guided by the law and regulations but also takes into account that all citizens should be treated equally;
  • is bound by professional confidentiality;
  • has wide powers in the investigation of a case;
  • listens to all sides of the argument;
  • evaluates impartially whether a complaint is valid or not;
  • issues recommendations arising from the complaint;
  • publishes an annual report which is available to the public.


The ombudsman always prioritises the right to speak and respond, for both parties in dispute. He listens to your version and to the version of the institution or organisation involved.

An ombudsman is neither a lawyer nor a judge, and the authorities and organisations are not obliged to follow his recommendations. Rather, ombudsmen rely on their moral authority to reach a satisfactory conclusion.

2.      How should you approach an ombudsman?

Before you take your complaint to an ombudsman, you should first try to resolve the matter with the administration or organisation concerned. If this first attempt fails, or if you’re not satisfied with the response, you can then take your complaint to the relevant ombudsman. They all have a website on which you can make your request.

The ombudsman will tell you rapidly whether he can deal with your complaint or not. The waiting time depends on the complexity of your situation but in any case, the ombudsman will keep you informed of progress.

3.      Who are the different ombudsmen?

The principal ombudsmen include:

  • the Federal Mediator, who investigates complaints against all federal authorities: taxation, social security, mobility, your identity, asylum and migration, detention of individuals, ...

Een Ombudsman : de oplossing voor een aantal problemen !

Hebt u een probleem met een administratie of organisatie, bij de overheid of in de privésector, dan kunt u met uw klacht terecht bij een bevoegd bemiddelaar. Er bestaan verscheidene soorten ombudsmannen en -vrouwen, elk met hun eigen werkgebied : belastingen, vervoer, verblijfsvergunningen, gezondheid, post, energie, pensioen, …. Een ombudsman onderzoekt uw klacht volledig onafhankelijk en in alle objectiviteit. Is uw klacht niet terecht, dan legt hij u uit waarom. Wat doet een ombudsman en hoe neemt u contact op ? U meent dat er een vergissing is gebeurd bij de behandeling van uw dossier en wacht tevergeefs op een antwoord van de betrokken administratie. Of u raakt niet binnen bij de administratieve dienst in kwestie. Aarzel dan niet om de bevoegde ombudsman te contacteren, ook soms « bemiddelaar » genoemd.

1.       Wat is de rol van een ombudsman ?

Een ombudsman behandelt uw klacht over een administratie of een organisatie als hiervoor geen oplossing gevonden kon worden. Hij :

  • is onafhankelijk ;
  • werkt kosteloos ;
  • baseert zich op de wet en op regelgevende teksten, maar houdt evenzeer rekening met de gelijke behandeling van de burgers ;
  • is gebonden door het beroepsgeheim ;
  • beschikt over ruime bevoegdheden om de klacht te onderzoeken ;
  • hoort alle betrokken partijen ;
  • onderzoekt in alle objectiviteit of de klacht gegrond is of niet ;
  • doet aanbevelingen op grond van de klachten ;
  • publiceert een jaarverslag dat iedereen kan inzien.

Voor de ombudsman staat het recht op spreken en antwoord voorop, en dat in alle billijkheid. Hij luistert naar uw versie en naar die van de administratie of de organisatie in kwestie.

Een ombudsman is geen advocaat en evenmin rechter. Administraties en organisaties zijn niet verplicht zijn voorstellen te volgen. Maar de ombudsman maakt gebruik van zijn morele autoriteit om te overtuigen.

2.       Hoe legt u klacht neer ?

Probeer vóór u een klacht indient het probleem eerst uit te klaren met de betrokken administratie of organisatie. Mislukt uw eerste initiatief of bent u niet tevreden met het antwoord, dien dan klacht in bij de bevoegde ombudsman. Deze beschikt steeds over een website waarop een klacht kan worden ingediend.

De ombudsman informeert u snel of hij uw klacht al dan niet kan behandelen. De wachttijd hangt af van de complexiteit van uw probleem, maar hoe dan ook houdt de ombudsman u op de hoogte van de evolutie van uw klacht.

Un Ombudsman : une solution à certains problèmes !

S’il vous arrive de rencontrer un problème avec une administration ou une organisation, du secteur public ou privé, vous pouvez contacter le médiateur compétent qui recevra votre plainte. 1.       Quel est le rôle d’un ombudsman ?

 Un ombudsman traite votre plainte à l’encontre d'une administration ou d'une organisation qui n’est pas parvenue à trouver une solution et il :

  • est indépendant ;
  • travaille gratuitement ;
  • se base sur les textes légaux et réglementaires, mais il tient compte également de l’égalité entre les citoyens ;
  • est tenu au secret professionnel ;
  • dispose de larges pouvoirs pour examiner la plainte ;
  • entend toutes les parties ;
  • examine en toute impartialité si la plainte est valable ou non ;
  • émet des recommandations à partir des plaintes ;
  • publie un rapport annuel à la disposition de tous.

L'ombudsman privilégie toujours le droit de parole et de réponse et ce, de manière équitable. Il écoute votre version et celle de l’administration ou de l'organisation concernée.

Un ombudsman n’est ni un avocat ni un juge. Les administrations et les organisations ne sont pas obligées de suivre ses propositions. Mais l’ombudsman s’appuie sur son autorité morale pour parvenir à les convaincre.

2.       Comment introduire sa plainte ?

Avant d'introduire une plainte, vous devez d'abord essayer de régler le problème avec l’administration ou l'organisation concernée. Si votre première démarche a échoué ou si vous n'êtes pas satisfait de la réponse, déposez une plainte auprès de l'ombudsman compétent. Chacun possède un site web via lequel une demande peut être introduite.

L’ombudsman vous informe rapidement s’il peut ou non traiter votre plainte. Le temps d’attente dépend de la complexité de votre problème mais dans tous les cas, l’ombudsman vous tient au courant de l’évolution de votre plainte.
