Buying a property: where to start?

Legislations and practices involving property acquisition differ from country to country. In Belgium, negotiations between seller and buyer are of great importance. A simple purchase offer countersigned by both parties equals to sale. It is therefore advisable to collect all the essential information before committing to the purchase. In general:

·         Once you have found a property of interest to you, a negotiation stage starts between the seller and the buyer, during which the parties agree on the price as well as the terms and conditions of the sale. Sometimes the seller calls on a real estate agency, which then acts as an intermediary in order to speed up negotiations, but which is not mandatory.

·         It is recommended not to sign anything without having consulted the notary-public. It is therefore advised to always pay attention before signing a bid!

·         It is not necessary to hire a lawyer, as is the case in other European countries. On the other hand, each party will need their own notary. You can find a complete directory of notaries in the country by postal code on the site https://www.notaire.be/other-languages/english-1

·         It is also good to know that the first consultation with a notary is always free of charge and that you will only pay his fees upon completion of the transaction.

·         The notary's fees are calculated in accordance with a set scale and are therefore the same for all public-notaries in Belgium. Contrary to lawyers, one notary is no more expensive than the other!

·         Many notaries speak English and sometimes even other languages. There are small notary firms but also larger ones, made up of associated notaries with numerous partners at your disposal. All notaries in Belgium are authorised to sign deeds of sale for the three regions. A notary in Brussels is therefore perfectly able to help you in the purchase of property in Wallonia, for example.

·         The notaries will initially be in charge of drawing up the provisional sales agreement, which will be followed, within four months at the latest, by the notarial deed of sale.

As a buyer, you should pay special attention to the following points before signing a bid or a preliminary sale agreement:

·         You may find it useful to visit the town planning department of your commune to look at the files available and compare the original plans with the current situation of the property. It is possible that some work has been undertaken without approval. In any case, your notary will write to the planning authorities to obtain the necessary town-planning information.

·         If you are financing the property purchase with a loan, it is wise to include a suspensive condition relating to the obtainment of credit in your purchase offer and/or preliminary sale agreement. This will protect you vis-à-vis the seller in the event that you fail to obtain the loan. This condition has a time limit however (generally 1 month) and should be negotiated with the seller.

·         When the preliminary sale agreement is signed, the purchaser will usually be required to pay a deposit of 10% of the sale price. This deposit remains blocked on the notary’s account until the final deed of sale is signed.

·         The seller is bound to supply you with the EPC (Energy Performance Certificate) – which reflects the energy consumption of the building – when the preliminary sale agreement is signed, at the latest.

·         The seller must also provide you with an electrical installation safety report prepared by an approved company. If this does not comply with legal requirements, you have up to 18 months from the date of the signature of the final deed of sale to put it in order.

·         If the property is situated in the Brussels or Flemish regions, the seller must provide you with a certificate of ground non-pollution. It is important to ascertain the quality of the ground and verify that the soil has not been polluted. Because if this is the case, regional regulations require various studies and measures to be carried out (which can be complex, long and costly).

·         If the property is currently rented out, you should examine the tenancy agreement and other rental documents (inventory of fixtures, existence or not of a security deposit, etc.) in order to determine the details of the notice to be given to the tenant.

·         Find out how much you have to pay in annual property taxes.

·         If you are buying an apartment, you should find out how the joint ownership functions. Ask for the documentation and read it carefully:

  1. The property management company: the amount of working capital and reserve funds, any payments in arrears, the status of current legal procedures relating to co-ownership, minutes of ordinary and extraordinary co-owners general assembly meetings of the last three years, regular accounts of charges of the last two years;
  2. The final deed of sale which describes the whole property and details the composition of private units (hall, bathroom, etc.) as well as their share (fraction) of communal areas;
  3. The joint-ownership regulations which include the rights and obligations of each joint owner (regulations relating to maintenance work, ban of certain activities, use of garden, etc.) and the way in which maintenance and repair charges for communal areas are allocated (for example, division of elevator charges);
  4. House rules (if there are any) which define certain practical arrangements such as those necessary or useful for harmonising the relationship between joint owners. Examples: are domestic animals permitted in the building? At what time must the front door be locked?...).
De wetgeving en de gebruiken betreffende de aankoop van een onroerend goed verschillen van land tot land. In België zijn de onderhandelingen tussen verkoper en koper belangrijk. Wanneer de koper en verkoper het eens zijn over de verkoopsmodaliteiten wordt de voorlopige of onderhandse verkoopovereenkomst opgesteld. Eens ondertekend door beide partijen is deze definitief en bindend en dienen de bepalingen van de overeenkomst als basis voor de notariële akte. Het is dan ook van groot belang dat de voorlopige verkoopovereenkomst zo duidelijk en volledig mogelijk wordt opgesteld. De Expat Welcome Desk licht toe.

In het algemeen:

·         Als je het huis van je dromen hebt gevonden beginnen de gesprekken tussen de verkoper en de koper over de prijs en de verkoopsvoorwaarden. Soms doet de verkoper een beroep op een immobiliënagentschap dat de onderhandelingen coördineert.

·         Aangeraden wordt om geen documenten te tekenen alvorens een notaris te hebben geraadpleegd en dus al zeker geen verkoopovereenkomst.

·         In België ben je, in tegenstelling tot andere Europese landen, niet verplicht een advocaat in de arm te nemen. Wel zal elke partij een notaris moeten kiezen. U vindt de volledige lijst met Belgische notarissen per postcode op de website https://www.notaris.be/verkopen-kopen-huren-lenen

·         Weet ook dat de eerste raadpleging bij een notaris gratis is en het honorarium pas wordt betaald wanneer het dossier is afgesloten.

·         Het honorarium van de notaris wordt volgens vaste barema’s berekend en is in heel België hetzelfde. In tegenstelling tot advocaten is de ene notaris niet duurder dan de andere.

·         Veel notarissen spreken behalve Nederlands en/of Frans, ook Engels en soms ook nog een andere taal. Soms werken verscheidene notarissen samen in een associatie. Alle notarissen van het land mogen verkoopakten ondertekenen voor de drie Gewesten. Zo kan een Brusselse notaris u bijvoorbeeld uitstekend bijstaan voor de verkoop van een eigendom in Wallonië.

·         De notaris zal de verkoopovereenkomst opstellen die, na maximum 4 maanden, definitief wordt bij de opstelling van de authentieke akte.

Als koper moet u aandacht besteden aan de volgende punten vóór u een verkoopovereenkomst of compromis ondertekent:

·         Het kan nuttig zijn om langs te gaan bij de dienst stedenbouw van de gemeente. U kunt er de beschikbare archieven inkijken en de oorspronkelijk plannen vergelijken met de huidige toestand van het goed. Misschien zijn er wel werken uitgevoerd zonder vergunning … De notaris schrijft stedenbouw aan om de vereiste stedenbouwkundige inlichtingen aan te vragen.

·         Als u de aankoop financiert met een krediet is het aangewezen om in uw aankoopbod en/of in het compromis de goedkeuring van uw krediet als opschortende voorwaarde te laten opnemen. Daarmee bent u beschermd ten opzichte van de verkoper als de bank de lening uiteindelijk niet zou goedkeuren. Dit is echter een voorwaarde die beperkt is in de tijd (doorgaans één maand) en die met de verkoper moet worden afgesproken.

·         Bij de ondertekening van het compromis wordt meestal van u verwacht dat u een voorschot betaalt van 10% van de verkoopprijs. Dit voorschot wordt geblokkeerd op de rekening van de notaris tot de ondertekening van de authentieke akte.

·         De verkoper dient u ten laatste bij de ondertekening van het compromis het EPB-attest te bezorgen (attest voor de energieprestaties) waaruit het energieverbruik van het gebouw blijkt.

·         De verkoper moet u ook een keuringsverslag van de elektrische installatie overhandigen, opgesteld door een erkende onderneming. Als de elektriciteit niet voldoet aan de wettelijke vereisten, beschikt u na de ondertekening van de authentieke akte over 18 maanden om deze in orde te brengen.

·         Is het goed gelegen in het Brussels of het Vlaams Gewest, dan dient de verkoper u een bodemattest te verstrekken. Het is immers belangrijk om na te gaan of de bodem in goede staat is en of er geen verontreiniging heeft plaatsgevonden. Is dit wel het geval, dan verplicht de wetgeving, die verschilt van het ene Gewest tot het andere, tot studies en maatregelen (die soms zwaar, lang en duur zijn).

·         Als het goed verhuurd is, dient u kennis te nemen van de huurovereenkomst en andere huurdocumenten (plaatsbeschrijving, het al dan niet bestaan van een huurwaarborg, e.d.) zodat u bekend bent met de opzegvoorwaarden waaraan u ten opzichte van de huurder gehouden bent.

·         Informeer u over het bedrag van de onroerende voorheffing (grondbelasting) die jaarlijks verschuldigd is.

·         Koopt u een appartement, informeer dan naar de werking van de gemeenschappelijke eigendom. Vraag en lees aandachtig:

  1. De informatie van de syndicus: het bedrag van het werkkapitaal en het reservefonds, de eventuele achterstallen, de staat van de lopende gerechtelijke procedures voor de gemeenschappelijke eigendom, de verslagen van de gewone en buitengewone algemene vergaderingen over de voorbije drie jaar, de periodieke kostenstaten van de voorbije jaren;
  2. De basisakte die een beschrijving geeft van het vastgoedgeheel met vermelding van de indeling van de appartementen (hall, badkamer...) en hun aandeel (breuk) in de gemene delen;
  3. Het reglement van de gemeenschappelijke eigendom waarin de rechten en plichten van elke mede-eigenaar vermeld staan (regels voor de uitvoering van werken, verbod op bepaalde activiteiten, gebruik van de tuin) en de spreiding van de lasten voor onderhoud en herstelling van de gemene delen (voorbeeld: lastenverdeling voor de lift);
  4. Het huishoudelijk reglement (indien er een is) waarin een aantal praktische dingen worden geregeld, en dan meer bepaald alles wat nodig is om de betrekkingen tussen mede-eigenaars vlot te laten verlopen. Voorbeelden: zijn er dieren toegestaan in het gebouw? Om hoe laat moeten de deuren gesloten zijn?...
Les législations et usages en matière d’acquisition immobilière diffèrent d’un pays à l’autre. En Belgique, la négociation entre le vendeur et l’acheteur revêt une certaine importance. Une simple offre contresignée par les deux parties vaut vente. Il vous est donc conseillé de rassembler tous les renseignements nécessaires à la vente avant de vous engager. De manière générale :

·         Lorsque vous avez trouvé un bien qui vous intéresse, s’ouvre une phase de pourparlers entre le vendeur et l’acheteur, lors de laquelle les parties se mettent d’accord sur un prix ainsi que sur les conditions de la vente.  Parfois le vendeur fait appel à une agence immobilière qui sert alors d’intermédiaire afin de faire avancer les négociations, mais cela n’est pas obligatoire.

·         Il est toujours conseillé de ne rien signer sans avoir consulté préalablement son notaire. Il convient donc de faire toujours attention avant de signer une offre d’achat et surtout de lui donner une date de validité !

·         Il n’est pas nécessaire de prendre un avocat pour se faire aider contrairement à d’autres pays d’Europe. Par contre chaque partie devra avoir son propre notaire. Vous trouverez un annuaire complet des notaires du pays par code postal sur le site www.notaire.be.

·          La première consultation chez un notaire est toujours gratuite et vous ne payez ses honoraires qu’à la fin de votre dossier.  

·         Les honoraires du notaire sont barémiques et sont donc les mêmes pour tous les notaires de Belgique. Contrairement aux avocats, il n’y a pas de notaire plus cher que d’autres !

·         Beaucoup de notaires parlent anglais et parfois même d’autres langues. Il existe de petites études notariales mais aussi de plus grandes études, composées de notaires associés avec de nombreux collaborateurs à votre disposition. Tous les notaires du pays sont habilités à signer des actes de vente pour les trois Régions. Un notaire de Bruxelles sera donc tout à fait en mesure de vous assister pour la vente d’un bien en Wallonie par exemple.

·          Les notaires se chargeront de rédiger d’abord le compromis de vente, qui sera suivi, dans les quatre mois au plus tard, de l’acte authentique de vente.

Plus précisément, en tant qu’acheteur, il convient d’être attentif aux points suivants avant de signer une offre ou un compromis de vente :

·         Il peut être utile de se rendre au service urbanisme de la commune pour consulter les archives disponibles et comparer les plans d’origine avec la situation actuelle du bien. Il se peut que certains travaux aient été réalisés sur le bien sans permis…De son côté le notaire se chargera d’écrire à l’urbanisme afin d’obtenir les renseignements urbanistiques nécessaires. Il pourrait être intéressant de vérifier que le bien ne se trouve pas en zone inondable.

·         Si vous financez l’acquisition au moyen d’un crédit il est prudent d’insérer dans votre offre d’achat et/ou compromis de vente une condition suspensive d’obtention de crédit qui vous protégera vis-à-vis du vendeur en cas de non obtention de votre crédit. Cette condition est toutefois limitée dans le temps (en général 1 mois) et doit être négociée avec le vendeur.

·         Lors du compromis de vente, il vous faudra très souvent payer un acompte de 10% du prix de vente. Il est important que cet acompte reste bloqué sur le compte du notaire jusqu’à l’acte authentique.

·         Le vendeur est tenu de vous remettre, au plus tard lors de la signature du compromis de vente, le certificat PEB (certificat de performance énergétique) qui reflète la consommation énergétique du bâtiment.

·         Le vendeur devra également vous communiquer un procès-verbal de contrôle de l’installation électrique effectué par une société agréée. Si celle-ci n’est pas conforme aux exigences légales, vous disposerez de 18 mois pour la remettre en ordre à dater de la signature de l’acte authentique.

·         Si le bien est situé en Région bruxelloise ou flamande, le vendeur devra vous délivrer une attestation de non-pollution du sol.  Il est en effet important de veiller à la bonne qualité du sol, et de vérifier que celui-ci n’a pas fait l’objet d’une pollution. Si cela devait être le cas, des législations, différentes selon les régions, imposent la réalisation de diverses études et mesures (parfois lourdes, longues et onéreuses).

·         Si le bien est loué, il convient de prendre connaissance de la convention de bail et autres documents locatifs (état des lieux, existence ou non d’une garantie locative, preuve éventuelle d’un renon, etc..) afin de vous renseigner quant aux modalités de préavis à donner au locataire.

·         Informez-vous sur le montant du précompte immobilier (impôt foncier) à payer annuellement.

·         Si vous achetez un appartement informez-vous sur le fonctionnement de la copropriété. Demandez et lisez attentivement:

  1. Les renseignements du syndic: le montant du fonds de roulement et du fonds de réserve, le montant des arriérés éventuels, le relevé des procédures judiciaires en cours relatives à la copropriété, les procès-verbaux des AG ordinaires et extraordinaires des trois dernières années (afin de vérifier par exemple que des gros travaux ne sont pas planifiés), les décomptes périodiques des charges des deux dernières années (les honoraires du syndic, l’assurance du bâtiment, l’entretien des communs, etc…) ;
  2. L’acte de base qui décrit l’ensemble immobilier en précisant la composition des unités privatives (hall, salle de bains, terrasse…) ainsi que leur quote-part (fraction) dans les parties communes ;
  3. Le règlement de copropriété qui reprend les droits et devoirs de chaque copropriétaire (règles par rapport aux travaux, interdiction de certaines activités, usage du jardin) ainsi que le mode de répartition des charges en ce qui concerne l’entretien et la réparation des parties communes (exemple : répartition des charges d’ascenseur) ;
  4. Le règlement d'ordre intérieur (s’il y en a un) qui définit certaines modalités pratiques, à savoir tout ce qui est nécessaire ou utile pour harmoniser les rapports entre copropriétaires. Exemples : peut-on avoir des animaux domestiques dans l'immeuble ? A quelle heure les portes doivent-elles être fermées ?...
