How to run a tourist accommodation in Brussels

Would you like to rent out your apartment or part of it, either independently or via a site such as Airbnb? A new regulation in Brussels stipulates that all tourist accommodation must be registered beforehand and monitored.

From 24 April 2016 you are obliged to fulfil several conditions in order to operate tourist accommodation, specifically:

- to take out third-party insurance;

- to conform to fire prevention standards (based on a certificate obtained from the burgomaster of your commune);

- to keep the premises in a good state of repair and cleanliness;

- to conform to urban planning requirements (based on a certificate from the town panning department of your commune);

- to obtain the written approval of the general assembly of co-owners if your residence is part of a condominium.

Once you have satisfied these requirements, you will receive a registration number and a logo to be displayed at the entrance of your residence.

A breach of this regulation can lead to a fine of 250 to 25,000 euros.

What about the tax implications? Rents are not taxed but you must declare the official cadastral income of your home (or a percentage if you rent only a part) in your tax return. This will then be taken into account in the global calculation of your tax assessment.

Wenst u af en toe uw appartement of een deel hiervan te verhuren via een website als Airbnb of op zelfstandige basis? In Brussel bepaalt een nieuwe reglementering dat alle toeristische logies vooraf moeten worden aangegeven en gecontroleerd.

Sinds 24 april 2016 moet u aan meerdere voorwaarden voldoen om een toeristisch logies uit te baten, en dan meer bepaald:

- een verzekering burgerlijke aansprakelijkheid sluiten;

- voldoen aan de normen inzake brandbeveiliging (met een attest aangevraagd bij de burgemeester van uw gemeente);

- uw woning in goede staat van onderhoud en netheid houden;

- voldoen aan de stedenbouwkundige normen (met een attest uitgereikt door de dienst stedenbouw van uw gemeente);

- beschikken over een schriftelijk akkoord van de Algemene Vergadering van mede-eigenaars indien uw logies gelegen is in een gebouw met meerdere eigenaars.

Van zodra u in regel bent, ontvangt u een registratienummer en een logo dat u aanbrengt bij de ingang van uw woning.

Wie de wetgeving niet naleeft, kan een boete krijgen van 250 tot 25.000 €.

En op fiscaal vlak? Huurgelden worden niet belast maar in uw jaarlijkse belastingaangifte moet u wel het kadastraal inkomen van uw woning vermelden (of een percentage als u slechts een deel hiervan verhuurt). Daarmee wordt vervolgens rekening gehouden in de globale berekening van uw belastingaanslag.

Vous souhaitez louer de temps à autre votre habitation ou une partie de celle-ci sur un site comme Airbnb ou de manière indépendante ? A Bruxelles une nouvelle réglementation prévoit que tous les hébergements touristiques doivent faire l’objet d’une déclaration préalable et d’un contrôle.

Depuis le 24 avril 2016, vous devez remplir plusieurs conditions afin d’exploiter un hébergement touristique notamment :

- souscrire une assurance responsabilité civile ;

- respecter les normes contre l’incendie (sur base d’une attestation à demander au bourgmestre de votre commune) ;

- maintenir votre habitation en bon état d’hygiène et d’entretien ;

- respecter les normes urbanistiques (sur base d’une attestation délivrée par le service d’urbanisme de votre commune) ;

- obtenir l’accord écrit de l’Assemblée générale des copropriétaires si votre hébergement fait partie d’une copropriété.

Une fois en ordre, vous recevrez un numéro d’enregistrement et un logo à apposer à l’entrée de votre logement.

En cas de non-respect de la législation une amende de 250 à 25.000€ pourra vous être appliquée.

Et sur le plan fiscal ? Les loyers ne sont pas taxés mais vous devrez déclarer, dans votre déclaration fiscale annuelle, le revenu cadastral de votre habitation (ou un pourcentage, si vous la louez en partie). Cela sera donc pris en compte dans le calcul général de votre imposition.
